Abstract

ROLE OF THE POLICE IN PRE-TRIAL CRIMINAL PROCEDURE |
Secondary abstract: |
Before the start of judicial criminal procedure, during the pre-trial criminal procedure, police examines and gathers information and important circumstances related to the criminal act, committed by the offender that is pursued upon official duty. Therefore, the Criminal procedure act defines a number of special rights and duties of the police: so called police authorizations. Most of them are carried out on the initiative of the police itself, but some can be performed only on the basis of an order of state prosecutor or investigating judge.
The main aim of policemen during the pre-trial procedure is gathering enough quality information and proofs to be able to suppose with a considerable level of probabiliy, that a certain criminal act was committed by a certain person. This level of probability is requested by the Criminal procedure act to start judicial criminal process.
