Abstract

Tako kot v Sloveniji se tudi v drugih državah Evropske unije srečujejo s problemom zaposlovanja starejših oseb. V nekaterih državah z ustrezno zakonodajo in spodbudami države uspešno rešujejo zaposlovanje starejših kljub naraščajočemu staranju delovne sile. V Sloveniji se skozi leta, od osamosvojitve naprej, stopnjuje odklonilni odnos delodajalcev do starejših delavcev. V primerjavi z nekaterimi razvitejšimi državami Evropske unije v Sloveniji zakonodaja in ukrepi države, usmerjeni k reševanju problema zaposlovanja starejših, ne sledijo trenutnim razmeram na trgu dela, ki jih zaznamuje gospodarska kriza. V diplomski nalogi je predstavljen zgodovinski razvoj zakonske ureditve starejših delavcev, delovnopravni položaj omenjenih delavcev v naši državi in njegova primerjava z izbranimi članicami Evropske unije, ki uspešno rešujejo zaposlovanje starejših delavcev.

Secondary abstract: In Slovenia as in other EU countries there has been an ongoing problem concerning the employment of older workers. Through appropriate legislation and other state incentives some countries have been able to successfully resolve this issue, regardless of the continuing rise of workers' median age. Since independence, Slovenia has seen a steady deterioration of employers' attitudes toward the prospect of hiring older workers. When compared to some of the more developed countries within the EU, it appears Slovenian legislation and other measures adopted by the state to combat the problem of employment of older workers do not correspond with the actual conditions on the labour market, which are aggravated even further by the ongoing economic crisis. In my thesis I have both outlined the history of laws regulating the employment of older workers and analyzed the legal status of these workers in Slovenia. I have also compared the legal status of older workers in Slovenia with corresponding legal frameworks adopted by some of those EU countries that have successfully resolved the issue of older workers' employment.
