Abstract
Ljudje se običajno zaposlujemo v državi prebivanja. Vedno tesnejša povezanost med posameznimi državami in želja po delu v tujini sta pripeljali do položaja, ko je zaposlovanje delavcev v tujini, kamor se nemalokrat tudi preselijo za namen dela, postal povsem običajen položaj. Evropska unija kot organizacija, ki povezuje več držav v enotno tvorbo, poenostavlja postopek zaposlovanja državljanov EU znotraj EU, za državljane tretjih držav pa določa enoten postopek za dostop do trga dela EU. Pravice, ki jih pridobijo delavci migranti iz tretjih držav, se razlikujejo glede na to, kakšen status delavci pridobijo. Lahko gre za visokokvalificirane delavce, dolgoročne rezidente ali povsem običajne delavce, ki vstopijo v EU z namenom zaposlitve. Vsaka država članica posebej določa število delavcev migrantov, ki jih bo sprejela na svoje ozemlje, prav tako pa je pred zaposlitvijo delavca tujca potrebno preveriti, ali ni mogoče na delovno mesto zaposliti domačega delavca, torej državljana EU.

People most common get employed in country of origin. Connection between states and wish of working in another state caused that employment in another country and moving there, with purpose of employment, becomes normal. European Union as organization, which connect member states into one formation, simplified procedure of employment member state's citizens, for third country nationals it provides unified procedure to get to the labour market of EU. Rights of migrant workers are different because of their status. They can be high qualified workers, long term residents or normal workers, that comes to EU with purpose of employment. Each member state provides number of migrant workers, that will be accepted in member state. It is necessary for each member state before employment of migrant worker, checking if maybe citizen of EU can be employed for that free job. |
