Abstract

Stavbna pravica je omejena stvarna pravica na tuji stvari, ki omogoča gradnjo stavbe na tujem zemljišču. Predstavlja izjemo od načela superficies solo cedit, po katerem je zgradba sestavni del zemljišča, na katerem stoji, kajti v času trajanja stavbne pravice je zgradba samostojna pravna stvar. Pravni institut stavbne pravice in sorodnih pravic se je v 20. stoletju razvil v skoraj vseh sodobnih evropskih pravnih sistemih. V diplomskem delu sem raziskala stavbno pravico dveh sosednjih držav, Republike Slovenije in Republike Hrvaške. Namen diplomskega dela je predstavitev temeljnih značilnosti in predvsem bistvenih razlik. Diplomsko delo je sestavljeno iz dveh sklopov. V prvem sklopu je predstavljena stavbna pravica slovenskega prava, njen nastanek, pravice in obveznosti strank ter prenehanje stavbne pravice. V enakem smislu je stavbna pravica hrvaškega prava predstavljena v drugem sklopu. V zaključku so zajete temeljne razlike med stavbno pravico slovenskega prava in »pravom građenja« hrvaškega prava.

Secondary abstract: Superficies is a restricted subject right, which enables the building of a building on a foreign property. It is an exception from the principle of superficies solo cedit, which states that the building is a part of the property on which it stands, as the building is an independent legal object for the duration of the superficies. The legal institute of superficies was developed in the 20th century in almost all modern legal systems. It is important for solving the problematic of restrictedness of properties, because superficies enables the expansion of living environments, while building costs are lowered. In this bachelor's thesis I explored the superficies in two neighbouring countries, the Republic of Slovenia and the Republic of Croatia. The aim of this thesis is to present the basic characteristics and, especially, the key differences. The thesis is composed of two segments. The first one presents superficies in Slovenian law, their origin, the rights and obligations of clients, and the cessation of superficies. The second segments presents superficies in Croatian law in the same manner. The conclusion presents an overview of the fundamental differences between superficies in Slovenian law and in Croatian law.
