Abstract

Pravica do vnaprej izražene volje daje pacientu upravičenje odločati, kakšna naj bo njegova oskrba in zdravljenje v primeru, ko sam ne bo sposoben podati svoje odločitve. Pravica poudarja avtonomijo volje pacienta, ter njegovo aktivnost pri skrbi za svoje zdravje. V praksi pomeni, da lahko vsak polnoleten pacient, ki je sposoben odločati o sebi, določi svojega zdravstvenega pooblaščenca, ki ima pravico do seznanitve s pacientovo zdravstveno dokumentacijo in zdravstvenim stanjem. Naloga je osredotočena na predstavitev pomena pravice do vnaprej izražene volje ter njenih predpostavk. Govori o omejitvah in izjemah pravice ter o pravni ureditvi v Sloveniji in na tujem. Diplomsko delo je namenjeno predvsem posameznikom, ki bi si želeli izvedeti več o pomenu pravice do vnaprej izražene volje, ter o njenem uveljavljanju.

Secondary abstract: The advance decision to refuse treatment gives a certain patient the right to decide about his curing and treatment in a situation, when he or she is not able to state his of her own decision. The right emphasises the patient’s autonomy and his or her own proactivity in personal health care. In practice, this gives every adult, capable of deciding for himself, an option to choose a health representative, who is later eligible to access subject’s medical files and health status. The paper is based on presenting the advance decision to refuse treatment and its presumptions, while also including limitations, exceptions to the right and legislative regulations in Slovenia and other countries. My diploma paper is intended especially for individuals who would like to receive more information about the Advance decision to refuse treatment and on invoking this right.
