Prenovljena ureditev izbrisne tožbe s pregledom aktualne sodne prakse

Abstract

Magistrsko delo z naslovom »Prenovljena ureditev izbrisne tožbe s pregledom aktualne sodne prakse« obravnava institut izbrisne tožbe v skladu z zadnjo novelo Zakona o zemljiški knjigi. V prvem delu je predstavljena ključna problematika ter namen mojega raziskovanja, ki se uvršča v področje zemljiškoknjižnega prava. Nato sledi predstavitev najpomembnejših novosti na področju zemljiškoknjižnega poslovanja in analiza samega instituta izbrisne tožbe, s poudarkom na prenovljeni ureditvi. V naslednjih poglavjih so izpostavljene posamezne dileme in dvomi, ki se pojavljajo pri reševanju konkretnih situacij. Na ta način so predstavljena stališča, ki se oblikujejo v teoriji in kakšen vpliv imajo na sodno prakso slovenskih sodišč, ki se je v zadnjem času kar precej dopolnila v primerih v zvezi z izbrisno tožbo. Analiziranje tematike izbrisne tožbe na podlagi sodne prakse je zato celovitejše prikazano in podprto s konkretnimi primeri.

Secondary abstract:	Master's thesis entitled »Renewed regulation of a claim for removal from the land register with an overview of current case law« deals with a renewed institut called a claim for removal from the land register in accordance with the latest amendment to the Zakon o zemljiški knjigi. The first part presents some key problems and the purpose of my research, which is classified to the land registry law. Followed by a presentation of the most important innovations in the field of land registry operations and analysis of the institute called a claim for removal from the land register, focusing on the renewed regulation. The following sections are exposed to specific dilemmas and doubts that arise in dealing with specific situations. In this way are presented views, formed in theory and what impact they have on the case-law of the Slovenian courts, which was recently quite supplemented in cases relating to a claim for removal from the land register. Analyzing the topic of a claim for removal from the land register based on the case law is so comprehensively illustrated and supported by concrete examples.
