Abstract

Diplomsko delo analizira Celovit gospodarski in trgovinski sporazum med EU in Kanado (CETA). Avtor najprej obravnava vzpostavitev območja proste trgovine z odpravo tarifnih postavk za blago. Pri tem se osredotoča, tako na industrijsko blago, s poudarkom na ribiški predelovalni in avtomobilski industriji, kot tudi na kmetijske izdelke. V okviru poglavja o blagu so predstavljena določila, ki se nanašajo na tehnične ovire trgovini, kot oblika necarinskih omejitev in na pravila izvora. V diplomski nalogi je tudi predstavljeno poglavje o prostem pretoku storitev, ki prav tako zajema začasno bivanje fizičnih oseb. Avtor, nadalje, obravnava določbe o naložbah; pri tem se osredotoča na inovativna pravila tega poglavja, katerih namen je ohraniti zakonodajno pristojnost strank na področjih javnega interesa, predvsem v kontekstu mehanizma za reševanje sporov med vlagatelji in državo (ISDS). Zadnje poglavje analizira pravila o intelektualni lastnini, ki se nanašajo na patente za farmacevtske izume in geografske označbe živilskih izdelkov.

Secondary abstract: The thesis analyzes the Comprehensive Economic and Trade Agreement between the EU and Canada (CETA). The author first deals with the establishment of a free trade area with the elimination of tariffs on goods. The focus is both on industrial goods, with an emphasis on fish processing and automotive industries, as well as agricultural products. In the chapter regarding goods the author also presents the provisions relating to technical barriers to trade, as a form of non-tariff barriers and rules of origin. The thesis also presents a chapter on the free movement of services, which includes temporary stay of natural persons. The author further deals with provisions on investment. The focus is on innovative regulations in this chapter, whose purpose is to preserve the legislative competence of the parties in the areas of public interest, especially in the context of the investor-state dispute settlement mechanism (ISDS). The last chapter analyzes the rules on intellectual property rights relating to patents for pharmaceutical inventions and geographical indications of food products
