Abstract

THE CHILD'S RIGHT TO KNOW HIS OR HER ORIGINS - GODELLI CASE |
Secondary abstract: |
Knowing one's own origin is a very important fact, which affects the shaping of our personality and the knowledge of one's own identity. This is why it is very inportanbt that everyone knows their ancestors and their origin. A child's right to know his/her origin means the right to know his/her birth parents, at least one of them. However, knowing one's origin largely depends on whether the child is born in a marriage or in a partnership, or if he/she was conceived naturally or with assisted reproduciton techniques, and if the child was adopted. The right of a child to know his/her origin is often limited by the right to privacy of third parties. When deciding between the right of a child to know his/her origins and the right of third parties to privacy, countries should derive from the best interests of the child. |
