Abstract

Posebni zemljiškoknjižni postopki, so postopki, ki so značilni le za nekatere specifične pravne položaje ter pravne institute in katere je prav zaradi tega zakonodajalec umestil v posebno poglavje zakona. Posebni zemljiškoknjižni postopki so tako postopek izbrisa starih hipotek, postopek nastavitve ter dopolnitve zemljiške knjige ter postopek vzpostavitve zemljiškoknjižne listine. V diplomskem delu z naslovom Posebni zemljiškoknjižni postopki s pregledom sodne prakse sem se osredotočil na obravnavo omenjenih postopkov predvsem z vidika sodne prakse Višjega sodišča v Kopru in sprememb, ki jih je prinesla uvedba novele Zakona o zemljiški knjigi (novela ZZK-1C). Le-ta se je pričela uporabljati s 1.5.2011. Diplomska naloga se prične z zgodovinskim pregledom zemljiške knjige, njeno organizacijo ter z obravnavo temeljnih načel zemljiškoknjižnega prava. Zajel sem tudi najpomembnejše vrste vpisov v zemljiško knjigo, k temu pa dodal še nepravilne vpise. V tretjem poglavju sem predstavil značilnosti zemljiškoknjižnega postopka in njegova načela, ki so izrednega pomena zaradi specifične narave le-tega. Temu sledijo nova postopkovna pravila zemljiškoknjižnega postopka, ki jih uvede novela ZZK-1C. Kot že omenjeno sem se v zadnjem delu naloge posvetil opisu posebnih zemljiškoknjižnih postopkov in sicer postopku izbrisa starih hipotek, postopku nastavitve in dopolnitve zemljiške knjige ter postopku vzpostavitve zemljiškoknjižne listine s pregledom sodne prakse. Ob pisanju diplomskega dela sem ugotovil, da je med posebnimi zemljiškoknjižnimi postopki v praksi najpomembnejši postopek vzpostavitve zemljiškoknjižne listine, pri katerem je zaslediti tudi največ sodnih odločb.

Secondary title: Special land registry procedures with the overview of case law
Secondary abstract: Special land registry procedures are procedures that are typical only to certain specific legal situations and legal institutions and this is why the legislator placed them in a special section of the law. Special land registry procedures are process of the deleting old mortgages, the process of adjustment and amendment to the land register and the process of establishing land registry document. In my diploma, entitled Special land registry procedures with the overview of case law I have focused on the treatment of these procedures especially in the light of the case law of the Higher Court of Koper and the changes brought by the introduction of the amendment made to the Land Register Act (amendment ZZK-1C). It started to use on the 1st May 2011. The diploma begins with a historical overview of the land registry, its organization and the treatment of the fundamental principles of the land registry law. I captured the most important types of land register records, to which I added a type of incorrect entries. In the third chapter I presented the characteristics of the land registry process and its principles, which are of utmost importance due to its specific nature. This is followed by a new procedural rules of the land registry procedure, established by the amendment ZZK-1C. As already mentioned I devoted the last part of the diploma to the description of special land registry procedures, namely the process of deleting old mortgages, the process of adjustment and amendment to the land register and the process of establishing a land registry document with review of a case law. While writing the diploma I found that among the specific land registry procedures in practice is the most important process of establishing a land registry document, which has detected the highest number of case law.
