Abstract
Diplomska naloga obravnava posebno področje civilnega procesnega prava, natančneje postopek v sporih majhne vrednosti oziroma posebnosti v primerjavi z rednim pravdnim postopkom. ZPP ureja postopek v sporih majhne vrednosti kot posebno vrsto postopka.
Rdeča nit postopka v sporih majhne vrednosti je vsekakor načelo ekonomičnosti in pospešitve, kar je razvidno iz vseh institutov, ki so posebnost prej omenjenega postopka in sovpadajo s samim namenom. Za to vrsto postopka veljajo specifična procesna pravila, ki se razlikujejo od rednega postopka ravno zaradi skladnosti med višino tožbenega zahtevka, ki je relativno nizka (2.000 oziroma 4.000 evrov v gospodarskih sporih majhne vrednosti) in stroški.
Zakonodajalec se je odločil ne le za drugačna procesna določila, temveč tudi za zreduciranje posameznih procesnih dejanj, predvsem na strani strank. Vse posebnosti postopka v sporih majhne vrednosti težijo k ekonomičnosti procesnih dejanj, vendar za seboj povlečejo omejitve, ki se logično pokažejo zaradi hitrosti celega postopka. Z diplomsko nalogo sem poskušal prikazati trenutno nacionalno pozitivno pravno ureditev, in ali takšna procesnopravna ureditev kot jo pozna Slovenija glede sporov majhne vrednosti res prinese želene učinke in pripomore k ekonomičnosti postopka.
V uvodnem delu je predstavljen pojem in sama umeščenost posebnega postopka v civilni pravdni postopek. V nadaljevanju so poudarjene razlike in posebnosti postopka v sporih majhne vrednosti v primerjavi z rednim pravdnim postopkom z analizo obsežne sodne prakse na to temo.

The thesis work deals with a specific area of civil procedural law, precisely the process of small claims, and peculiarities in comparison with the regular litigation. The Civil Procedure Act (hence ZPP) governs the procedure for small claims as a separate process.
The main theme of the procedure in small claims is indeed the principle of economy and expedite the procedure, as is evident from all the institutes, which are a specialty of the aforementioned procedure and coincide with the single purpose. For this type of procedure, subject to the specific procedural rules that differ from the normal procedure precisely for reasons of consistency between the amount of the claim, which is relatively low (2,000 or 4,000 euros in economic matters) and the costs of the proceedings.
The legislature decides not only for the different procedural provisions, but also to reduce the procedural matters, particularly on the parties. All the specifics of the case in small claims lean towards the economy of procedural acts, but for themselves pulled restrictions, which logically show because of the speed of the whole process. With the thesis/ project work I try to present the current national positive regulation of this process, and whether such a procedural arrangement, as it is known by Slovenia in respect of small claims really brings the desired effects and contributes to the economy of procedure.
The introductory section presents the concept itself and the placement of a special procedure in civil procedure. The following highlights the differences and the particularities of the case in small claims in comparison with the regular litigation with extensive jurisprudence on this topic. |
