Abstract

Diplomsko delo z naslovom Mednarodno običajno pravo kot vir mednarodnega prava obravnava običajno pravo kot najstarejši mednarodnopravni vir ter ga uvršča med ostale pomembne vire mednarodnega prava. Na mednarodnem področju sodijo običaji med formalne vire. Pri razvoju običajnega prava je pomemben tako čas kot tudi neko dejanje, katero se ponavlja v določenem časovnem obdobju. Za nastanek norme običajnega prava morata biti izpolnjena dva pogoja hkrati. To sta objektivni pogoj, tako imenovan splošna praksa, ter subjektivni pogoj oziroma pravna zavest, s katero so subjekti mednarodnega prava sprejeli to prakso za obvezujočo. Običajno pravo kot vir mednarodnega prava najdemo v 38. členu Statuta Meddržavnega sodišča ter v 8. členu Ustave Republike Slovenije , kjer je posredno naveden v besedni zvezi »splošno veljavna načela mednarodnega prava«. Pri uporabi in dokazu obstoja mednarodnih običajev pa lahko naletimo na nekatere ovire.

Secondary abstract: The Thesis entitled International customary law as a source of International law, deals with customary law as the oldest source of International law and it places it among other important sources of International law. It belongs to formal sources. In the development of customary law, time as well an action which is repeated in certain time frame, is important. For the creation of rules of customary law two conditions must be fulfilled at the same time. . Objective condition, which is common practice of the Court and the subjective condition or legal consciousness, with which the subjects of International law accepted this practice as binding. Customary law as a source of International law is found in Article 38 of the Statute of the International Court of Justice and in the Article 8 of the Constitution of Slovenia, where is indirectly referred in the phrase »generally accepted principles of International law«. In application and evidence of existance of customary Internationa law we may encounter some obstacles.
