Abstract

V diplomskem delu sem poudarila kontradiktornost med obveznim cepljenjem določenim v 22. členu Zakona o nalezljivih boleznih (ZNB) in 35. členom Ustave republike Slovenije (URS), ki govori o varstvu pravic zasebnosti in osebnostnih pravic. Predstavila sem zgodovinski razvoj cepljenja, definirala pojem cepljenja, cepiva in imunost. Opisala sem tudi stranske učinke. V nadaljevanju sem se osredotočila na slovenske organe in njihove spodrsljaje, povezane z dokumenti in spremljanjem stranskih učinkov cepiva. Prav tako sem se osredotočila na slovensko društvo za svobodo odločanja (SVOOD), ki je največji nasprotnik cepljenja v naši državi. Po spodrsljajih in pobudah naših organizacij sem se osredotočila na slovensko in tujo zakonodajo. Na slovenskem področju sem dala poudarek na pravice staršev pri odločanju, ali bodo otroka cepili ali se le-temu izognili. Podrobneje sem preučila tudi sankcije, ki sledijo upirajočim se staršem. Podatke, ki sem jih zbrala, sem nato primerjala s svetovno zakonodajo povezano s cepljenjem, izpostavila pa sem našo državo in EU članice, kot so Velika Britanija, Malta, Italija, Hrvaška in Avstrija. Za zaključek sem naredila še vprašalnik in ga naslovila na različne Facebook skupine, v katerih so pretežno matere. Rezultati so me šokirali, saj so bili posledica nezaupanja v zdravstvo in farmacijo. Če bi sodila po rezultatih ankete, bi lahko rekla, da je trenutna zakonodaja v prid obveznemu cepljenju, in ne željam posameznika.

Secondary abstract: In the thesis, She emphasized the adversarial nature of compulsory vaccination and Article 35 of the Constitution that talks about protection of privacy and personal rights. It presents the historical development of vaccination, defined the concept of vaccination, vaccines and immunity. It describes the side effects, which may occur at individual vaccination. Furthermore it focuses on the Slovenian authorities and their lapses related to the documentation and monitoring of side effects of the vaccine itself. I also focused on the Slovenian Association SVOOD, which is the biggest opponent of vaccination in our country. After the failures and initiatives of our organizations, I focused on the Slovenian and foreign law. In the Slovenian area, I gave particular emphasis to the parents’ rights in the very deciding whether to vaccinate a child or to avoid it. More specifically, there are also considered sanctions against parents resisting the compulsory vaccination. The data collected and then compared to global legislation related to the vaccine-but I put emphasis on our country and some EU countries, e.g. Great Britain, Austria, Malta, Italy and Croatia. In conclusion,there is a questionnaire that was sent to various Facebook groups, whose members are predominantly women. The results shocked me because they showed distrust in the health care and pharmacy. Judging by the results of the survey, it could be said that it is in favour of mandatory vaccination than on behalf of people who strictly oppose the existing system.
