Abstract

Ljudje se pogosto ne zavedamo vpliva, ki ga ima zunanji svet na nas. Človek je po naravi analitik, kar pomeni, da neprestano zbira, obdeluje in tolmači podatke iz okolice. Podatkom, ki jih obdelamo, vedno dodamo osebno noto, jih poosebimo. V diplomskem delu z naslovom policijska pristranskost in pojav izsiljenih priznanj bomo predstavili policijsko zaslišanje v predkazenskem postopku. Zaslišanje je pomemben del predkazenskega postopka, ki ima lahko odločilen vpliv na nadaljnji potek kazenskega postopka in na sodbo. Policisti naj bi bili pri svojem delu čimbolj objektivni, kar je v praksi velikokrat težko. Vsaka oseba že v mladosti razvije različne obrambne mehanizme, ki imajo velik vpliv tudi kasneje v življenju, kar je lahko nevarno, še posebej takrat, ko ima taka oseba določena pooblastila, moč. Tako kot ostali ljudje, so policisti žrtve predsodkov in stereotipov, ter tudi sami stereotipizirajo in imajo predsodke, kar posledično vodi v razvoj pristranskosti. Ravno zato je pri opravljanju vsake policijske naloge, ne zgolj zaslišanja, potrebna visoka raven strokovnosti, usposobljenosti, zakonitosti in etičnosti. Nestrokovno izvedeno zaslišanje lahko hitro vodi v hujše kršitve zakonov, Ustave in človekovih pravic in temeljnih svoboščin, in ravno zato smo zaslišanju v tem delu posvetili tolikšno pozornost. Svoboda ima za človeka neprecenljivo vrednost, in je danes ena najbolj cenjenih dobrin in pravic.

Secondary abstract: People are often unaware of the influence the outside world has on us. Humans are analysts by nature, which means they constantly accumulate, process and interpret information from the surroundings. The information, which is processed, is always personalized. In this thesis titled Police Bias and Forced Confession we are going to take a closer look at Police interrogations. Interrogations are a very important part of the criminal proceeding and can have an enormous impact on the outcome of the judgement. Police officers should al-ways be objective in their line of work, which is easy to say in theory but is much harder to achieve in practice. Every person develops defence mechanisms at an early age. The said defence mechanisms have a big impact on the person later in life, which can be dangerous, especially when such a person is given special au-thorization or power. Police officers, like everybody else, are targets of many prejudices and stereotypes, and in turn are prejudicial and stereotypical towards other people. The use of prejudices and stereotypes leads to the development of bias. To prevent that from happening, high standards of professionalism, capabil-ity, legality and ethics should be met. Unprofessional interrogations can lead to severe infractions of criminal law, the constitution, and basic human rights. We payed special attention to interrogations, due to their potential to threaten the basic human rights. Freedom as a right is priceless and today it is regarded as one of the most appre-ciated, valued and respected rights and goods.
