Abstract

Po navadi menimo, da je za razumevanje nekega besedila dovolj, da obvladamo le področje iz katerega besedilo izhaja. Vendar temu zagotovo ni tako, kar še posebej občutimo pri obravnavanju strokovnih besedil. Poleg tekstualnega so pomebni tudi leksikalni vidiki obravnavanega besedila. V tej diplomski nalogi se bomo ukvarjali z z besedilom Kazensega zakonika Republike Slovenije ter z njegovim, javno dostopnim angleškim prevodom ter se tako osredotočili na značilnosti obeh besedišč. Pred začetkom same analize zakonika, smo najprej opisali nekatere tekstualne značilnosti besedil. Ker besedilo kazenskega zakonika spada med pravna besedila, smo opisali še lastnosti le-teh. Poleg tega pa je, za popolno razumevanje teksta, pomembno tudi razumevanje besedišča, ki naše besedilo sestavlja. S tem pa pridemo do glavnega dela diplomske naloge, analize besedišča: iz besedila Kazenskega zakonika smo izluščili petdeset najpogosteje uporabljenih samostalnikov, petdeset glagolov, trideset pridevnikov ter si pobližje pogledali kolokacije, ki se v besedilu pojavljajo. Pri tem smo si pomagali s programom Simple Concordance Program. Poiskali smo vse kombinacije izbranih besed z ostalimi samostalnik, pridevniki, glagoli ter predlogi in prislovi v primero, da so bili le-ti del določene fraze. Glede na frekvenco pojavitje izbranih besed, je bil pokrit zadosten dela Kazenskega zakonika in nam s tem omogočil ustrezno razumevanje zakona. Rezultat dela je nabor terminov, ki ga študent potrebuje za učenje in razumevanje kateregakoli pravnega teksta. Ker ustvarjeni seznam poleg angleških fraz vsebuje še njihove slovenske prevode, lahko služi kot pripomoček za branje ter prevajanje angleških prevodov kazenskih zakonikov tujih držav.

Secondary abstract: Usually we believe that for understanding a text it is enough that we master the field it belongs to. However, this is not the case when we deal with specialized texts, such as legal texts. In addition to textuality criteria, lexical aspects of the text are important as well. In this dissertation, we use the original text of the Penal Code of The Republic of Slovenia in Slovenian and its publically available English translation to focus on some of their contrastive features of their separate vocabularies. At the very beginning, we describe some textual aspects, stating some general characteristics of legal texts. But to really understand a text is to fully comprehend its vocabulary in its phrase structure. Therefore, the main body of the dissertation is an analysis of the vocabulary: we chose fifty most frequently used nouns, fifty verbs, and thirty adjectives contained in the Penal Code and took a closer look at their collocates through means of a concordance program. We looked for all occurrences of the selected words and their combinations with other nouns, adjectives, and verbs, including some prepositions and adverbs if they were an integral part of a particular phrase. Because of their frequency of appearance, the words analyzed cover a vast portion of the text, allowing for an adequate understanding of the Penal Code. The results is a core lexicon a student needs to develop and master in order to understand an English translation of any legal text. Further, this contrastive analysis results in a list of most frequently used phrases in the English translation of the Penal Code of the Republic of Slovenia, complemented by their Slovene equivalents. As such, it may be used for meaningful reading of English translations of penal codes adopted by other countries and as an accessory for translating them.
