diplomsko delo visokošolskega strokovnega študija Varnost in policijsko delo
Abstract
V demokratični družbi, kakršna je tudi Republika Slovenija (v nadaljevanju RS), je policijsko delo urejeno z ustavo, zakoni in podzakonskimi akti. Zakonska določila morajo policisti pri izvajanju svojih pooblastil in nalog dobro poznati in jih dosledno spoštovati, pri tem pa morajo spoštovati tudi temeljne človekove pravice in svoboščine, kajti to je osnova za strokovno, korektno in zakonito izvajanje policijskih nalog. Policija in njeni pripadniki morajo v primeru nezakonitega, neprimernega in nekorektnega ravnanja prevzeti odgovornost za svoja dejanja, saj se na ta način zmanjšujejo nepravilnosti pri izvajanju policijskih postopkov, s tem pa se hkrati krepi zaupanje javnosti v delo policije. Da je temu tako, imamo v RS vzpostavljen institut pritožbe zoper delo policije, ki predstavlja neke vrste reklamacijo na policijsko delo in ki državljanom omogoča, da se v primeru nepravilne oz. nezakonite izvedbe policijskega postopka na le-tega pritoži. Pritožbeni postopek lahko tako sproži vsakdo, ki meni, da so mu bile v policijskem postopku kršene njegove človekove pravice in svoboščine. Omenjeni postopek je podrobneje predstavljen tekom naloge, hkrati pa je predstavljena tudi negativna definicija pritožbe. Poznavanje in razumevanje negativne definicije pritožbe je pomembno, saj so številne pritožbe podane kljub temu, da ne ustrezajo definiciji pritožbe oz. da so določeni pritožbeni razlogi napačni. Ker se posamezniki najpogosteje pritožujejo nad delom policistov v cestnem prometu, smo našo pozornost namenili ravno omenjenemu področju in tako predstavili načela ter zakonsko podlago za izvajanje policijskih postopkov v cestnem prometu.
V empiričnem delu naloge smo izvedli analizo utemeljenih pritožb v cestnem prometu. Rezultati izvedene analize lahko predstavljajo vodilo za zmanjševanje nepravilnosti pri izvajanju policijskih postopkov. Ugotavljamo, da se v obravnavanem obdobju pozitiven trend števila podanih in utemeljenih pritožb zoper delo policije v cestnem prometu zmanjšuje.

AN OVERVIEW OF THE SUBSTANTIATED COMPLAINTS AGAINST POLICE WORK IN THE FIELD OF ROAD TRAFFIC CONTROL |

In a democratic society, such as the Republic of Slovenia (hereinafter: RS), the police work is regulated by the Constitution, laws and bylaws. Police officers should be well familiar with the exercise of its powers and functions. The Constitution, laws and bylaws shall be well and consistently respected. Police must also respect and be aware of fundamental human rights and freedoms, as it is the basis for the professional, proper and lawful performance of police duties. In the case of illegal activity, unsuitable or improper conduct, police officers and its members shall take responsibility for their actions. It is the way to reduce irregularities in the implementation of police procedures, as well as to strengthen public confidence in the police and its work. RS has an institute for complaints against possible irregular police work. It enables citizens to claim any violation of their human rights and freedoms or whatsoever and complain about any unsuitable handling by the police. The process mentioned above is presented in detail during the thesis, but we should also be aware of a negative definition of the complaint. Knowledge and understanding of the negative definition of the complaint are important because many of those complaints made do not meet the proper definition of a complaint. The complaints are commonly false and unjustified. Since individuals most often complain about the work of police officers in the field of road traffic control, we have pointed our attention to that specific area. As the subject is that specific field, principles for the implementation of police procedures and the legal basis for the implementation of those police procedures will be here detailed and defined.
In the empirical part of the thesis, we performed an analysis of eligible complaints in the field of road traffic control. The results of the analysis indicate that irregularities in the implementation of police procedures are reducing. We note that in the period 2010 - 2014, the positive trend in the number of given and eligible complaints against the police work in the field of road traffic control is decreasing. |
