Abstract
Reforma politike do drog zajema tako že izvedene kot predlagane spremembe znotraj konvencionalnega pristopa vlad k pojavu, povezanim s prepovedanimi drogami. Konvencionalni pristop se osredotoča na represijo, kaznovanje in izkoreninjanje, medtem ko novi modeli sprejemajo droge kot sestavni del človeške narave in v skladu s tem določajo realne cilje. Cilje, kot so zmanjševanje škode, nastale zaradi uporabe drog, zmanjševanje ponudb in povpraševanja ter zagotavljanje prilagojenih načinov zdravljenja kot varstva človekovih pravic. Zadnje desetletje je zaznamoval val dekriminalizacije posedovanja in uživanja prepovedanih drog po vsem svetu. Tisti najbolj liberalni zagovarjajo legalizacijo drog oz. legalizacijo proizvodnje in trgovine. Vsaka država se spopada s posledicami, ki nastanejo zaradi proizvodnje, trženja in uporabe prepovedanih drog, zaradi česar morajo nosilci odločanja ustvariti ustrezno strategijo in politiko. Dozdajšnji poudarek, ki je temeljil na represiji, ni dal zadovoljivih rezultatov in je celo prispeval k nasprotnemu učinku. Vojna proti drogam in ničelna toleranca do njih je tudi uradno razglašena za neuspelo politiko ter posledično spodbuja intenzivno delo pri spremembah tako pravnega okvira kot konvencionalnih represivnih praks. Zaradi tega si je mnogo vlad po vsem svetu začelo prizadevati za doseganje boljših rezultatov in začelo izvajati reforme svoje zakonodaje in politike do prepovedanih drog.
V magistrskem delu smo poskusili prikazati postopne spremembe v politiki do prepovedanih drog na globalni ravni ter številne aktualne in trenutno uporabljane reforme, na primer štiristopenjski model, znan tudi kot Frankfurtski model, ter njegovo vlogo v Frankfurtu in Vancouvru. Na koncu je predstavljena politika do prepovedanih drog kot zakonski okvir Republike Slovenije. V empiričnem delu naloge bomo predstavili rezultate analize sodnih evidenc.

The Drug policy reform involves implemented and proposed changes of the conventional government approach to the drug related phenomenon. The conventional approach focuses on repression, punishment and eradication, while new models accept drugs as a part of human nature and accordingly set more realistic goals such as reducing the damage caused by the use of drugs, reducing supply and demand, providing customized treatments and protection of human rights.
The last decade was marked by a wave of decriminalization of possession and use of drugs around the world. The most liberal politicians advocate the legalization of drugs and control of their production and trade. Each country faces the consequences incurred by production, trafficking and use of drugs. To minimize negative consequences every state needs to have an adequate strategy and drug policy. The current emphasis on repression did not give great results; on the contrary it even had the opposite effect to some extent. War on Drugs and zero-tolerance drug policy are formally declared as failed policies. Efforts have been intensified to amend the legal framework and the conventional repressive practices. That is why countries around the world have begun to engage in various forms of reform of its legislation and drug policy in an effort to made better results in terms of the phenomena related to drugs.
Through the master's thesis, the effort was given to show gradual changes in drug policy at the global level, ways of reforms which are en option and which are currently in apply. The four pillars model is also presented as well as its application in the city of Frankfurt, Germany (Frankfurt model) and the city of Vancouver, Canada. At the end is presented drug policy and legal framework of the Republic of Slovenia. The analysis of court cases is presented in the empirical part of the thesis. |
