Abstract

V diplomskem delu smo opisali in shematsko prikazali proces gradnje in obratovanja objekta ter podali udeležence z opisom nalog, ki jih opravljajo znotraj teh procesov. Opisali smo odgovornosti udeležencev pri gradnji ter podali garancijske roke, v katerih odgovarjajo za opravljeno delo. Poudarili smo odpravo napak na objektu ob primopredaji med izvajalcem in investitorjem ter ob primopredaji med investitorjem in kupcem. S tem namenom smo opisali pomen Navodil za obratovanje in vzdrževanje objekta, pomen bančne garancije za odpravo napak v garancijski dobi po gradbeni pogodbi ter pomen bančne garancije po Zakonu o varstvu kupcev stanovanj in enostanovanjskih stavb. Sledi opredelitev in način vzpostavitve etažne lastnine po Stvarnopravnem zakoniku. Ureditev etažne lastnine smo primerjali z ureditvijo v Republiki Hrvaški. Prav tako smo z Republiko Hrvaško primerjali področje upravljanja večstanovanjskih stavb, pri čemer smo izpostavili zakonodajno ureditev področja vzdrževanja večstanovanjskih stavb. V empiričnem delu smo ugotavljali kako sprememba ZGO-1B vpliva na obveznost izdelave Navodil za obratovanje in vzdrževanje, izračunali primere solastniških deležev na skupnih delih stanovanjsko-poslovne stavbe ter analizirali stroške obratovanja in vzdrževanja med prvim in petim letom obratovanja stanovanjsko-poslovne stavbe. Opisali smo tudi primera poskusa unovčenja garancij za odpravo napak v garancijski dobi.

Secondary abstract: In this paper, we described and schematically demonstrated the process of building construction and operation, listed the participants and described the tasks they perform in these processes. We described the responsibilities of participants in construction and defined the warranty periods, during which they are responsible for the work performed. We highlighted elimination of defects on the building at the handover between the contractor and the investor and at the handover between the investor and the buyer. With this purpose, we described the importance of Instructions for Operation and Maintenance of Buildings, the importance of bank guarantee for elimination of defects during the warranty period set out in the contract on construction, and the importance of bank guarantee in accordance with the Protection of Buyers of Apartments and Single Occupancy Buildings Act. This is followed by a definition of floor ownership and the manner of establishing floor ownership in accordance with the Law of Property Code. We compared floor ownership regulation in Slovenia with floor ownership regulation in the Republic of Croatia. We also compared apartment building management with the Republic of Croatia, and highlighted the legislative regulation of apartment building management. In the empirical part of the paper, we determined how the changes to the Construction Act affected the obligation of creating Instructions for Operation and Maintenance of Buildings, calculated examples of co-ownership shares in the common parts of a residential-commercial building and analysed operation and management costs between the 1st and the 5th year of operation of a residential-commercial building. We also described examples of attempts to realize guarantees for elimination of defects during the warranty period.
