Abstract

Zadnja finančna kriza, ki je posledica globalne finančne nestabilnosti, je pokazala na pomembnost rastočega senčnega bančništva. Senčno bančništvo se navezuje na aktivnosti v zvezi z likvidnostjo, kreditnim posredništvom in spremembo ročnosti finančnih sredstev, ki potekajo zunaj urejenega bančnega sistema. Senčno bančništvo tako poimenujemo zaradi izmikanja bančnim regulacijam. V magistrski nalogi smo se osredotočili na senčno bančništvo v Evropski uniji in Združenih državah Amerike. Predstavili smo pojem senčnega bančništva, njegovo vlogo in način delovanja. Opisali smo glavne subjekte in aktivnosti, ki tvorijo senčni bančni sistem. Kljub problemom z razpoložljivostjo podatkov smo primerjali obseg senčnega bančništva v EU in ZDA in ugotovili, da je ta manjši v EU kot v ZDA. Ugotovili smo tudi, da se je velikost senčnega bančništva v EU povečala v času finančne krize, medtem ko so razmere v ZDA šle v drugo smer: v času krize se je obseg dejavnosti v senčnem bančništvu v ZDA zmanjšal. Regulacija bančništva je bila v preteklosti zelo pomanjkljiva. V želji, da se v bodoče ne bi ponovila gospodarska kriza v enakih dimenzijah, pa so na območju Evrope in v Združenih državah Amerike finančni izvedenci v interakciji z regulatorji na novo napisali oz. izpopolnili zakone, ki so do zdaj imeli pravno moč na finančnih trgih. V EU so dopolnili zavezujoče direktive zbrane v Basel III; v ZDA so pravno potrdili celosten zakonik, imenovan Dodd-Frankov zakon, katerega cilj je sistematizirati kompleten ameriški finančni sektor.

Secondary title: Comparison of shadow banking between the European Union and the United States of America
Secondary abstract: Recent financial crisis resulting in global financial instability pointed at the importance of shadow banking growth. Broadly speaking, term shadow banking refers to activities related to credit intermediation, liquidity and changing the maturity of financial assets held outside the regulated banking system. Shadow banking is called so because of its avoidance of bank regulation. In the thesis, we have focused on shadow banking in the European Union and in the United States of America. We have introduced the concept of shadow banking, its role and way of operation and have described the main subjects and activities that compose the shadow banking system. Despite the problems with the availability of data, we compared the size of shadow banking in the EU and the US. We found out that shadow banking activity in the EU is smaller than in the United States. We also established that EU shadow banking market increased in size during the financial crisis while the situation in the U.S. went in the other direction, i.e. during the crisis, the amount of shadow banking activities declined in size. Supervision of the shadow banking system in the past was very poor. That the economic crisis in the same scale would not happen in the future, financial experts in cooperation with regulators in the territory of Europe and United States of America have newly written or have updated laws that have so far applied on financial markets. In the EU they have completed binding directives, which are gathered in Basel III, while in the USA they have adopted a law called the Dodd-Frank Act, which seeks to regulate the entire American financial sector.
