Abstract

Stečajni postopek oziroma stečaj je prenehanje prezadolženega oziroma plačilno nesposobnega dolžnika, ki je namenjen hkratnemu in sorazmernemu poplačilu upnikov. Diplomska naloga se osredotoča na osebni stečaj in stečaj nad pravno osebo. Naloga obravnava kvalitativne razlike med obema stečajema v povezavi s fazami stečajnega postopka, stečajno maso, stroški, pravicami in trajanjem. V nadaljevanju se osredotoča na kvantitativen vidik obeh stečajev, pri čemer izpostavlja statistične podatke med leti 2009 in 2015. Oba vidika sta prav tako predstavljena za primer Hrvaške in primerjana s Slovenijo. Glavne razlike med obema stečajema se kažejo v odpustu obveznosti, prenehanju subjektov in zakonski omejitvi trajanja stečaja. Generalno gledano se število obeh stečajev povečuje, s to razliko, da trend osebnega stečaja narašča eksponentno, medtem ko trend stečaja nad pravno osebo, linearno. Primerjava Slovenije s Hrvaško pokaže, da je v splošnem trajanje obeh stečajev na Hrvaškem krajše, kot posledica proceduralnih razlik. Pomembnejše razlike se kažejo v začetni fazi postopka stečaja, njegovih organih in preizkusnem obdobju pri osebnem stečaju.

Secondary title: ǂA ǂcomparison of personal bankruptcy and the bankruptcy of a juridical person
Secondary abstract: Bankruptcy proceeding or bankruptcy denotes the termination of over-indebted or insolvent debtor, and is intended for concurrent and proportional repayment of creditors. The thesis focuses on personal bankruptcy and the bankruptcy of a juridical person (legal entity). The paper deals with the qualitative differences between the two in relation to the phases of the proceeding, the mass, the expenses, and to the rights and duration. The following chapter focuses on the quantitative aspect of both bankruptcies with the emphasis on the statistical data between 2009 and 2015. Both aspects are also presented for Croatia and further compared with Slovenia. The main differences between both bankruptcies are reflected in the dismissal of the duties, cessation of the debtor, and legal time limit of the proceeding. Generally speaking, the number of both bankruptcies is increasing, the only difference being that in the case of personal bankruptcy the trend growth is exponential, while in the case of a legal entity, linear. A comparison between Slovenia and Croatia reveals that in general the duration of both bankruptcies is shorter in Croatia due to procedural differences. More prominent differences can be seen in the first stage of the proceeding, its bodies, and in a trial period of personal bankruptcy.
