Abstract
Diplomsko delo obravnava argument teleološke redukcije. Argument temelji na rezultatu teleološke metode razlage, ki pa je zagotovo teoretično ena najbolj spornih metod razlage pravnih aktov. Opredelitev objektivnega smisla oz. namena (ratio legis) je pogosto zapleteno in problematično opravilo. Običajno je rezultat razlage omejen z jezikovnim okvirom norme, vendar teleološka redukcija pripisuje besedilu pomen, ki ga jezik besedila ne podpira. Njen rezultat je celo »contra verba sed secundum rationem legis«, zato je še bolj sporna. Argument teleološke redukcije podpira tezo, da se pravno pravilo ne nanaša na konkretni primer, če je rezultat njegove uporabe (tj. pravna posledica oz. sankcija) v konkretnem primeru v nasprotju z namenom zakona. Zaradi navedenega je potrebna posebna previdnost pri iskanju namena. Teorija govori o težkih primerih, ki temeljijo na tehtanju in uravnoteženju. V tem primeru nimamo opravka zgolj z razlago ampak z nadaljnjim razvijanjem prava oz. doktrino zapolnjevanja pravnih praznin.
V prvem delu avtor z namenom opredelitve teleološke redukcije obravnava teleološko razlago, primerjalno obravnava nekatere povezane ustaljene kanone razlage, primerja pravno praznino, ki se zapolnjuje s teleološko redukcijo, s pravo klasično pravno praznino in ugotavlja, da je razlika do pravih praznin bistvena, saj ne gre za odsotnost pravne ureditve, ampak za praznino, ki se pojavi kot posledica interpretacije (prekrita oz. vrednostna praznina). Obravnavani so vidiki, zaradi katerih je razlikovanje pomembno. V zadnjem poglavju je predstavljena sodna praksa uporabe argumenta teleološke redukcije.

Thesis deals with the argument of teleological reduction, based on the teleological method of interpretation, which is theoretically certainly the most controversial method of the interpretation of legal acts. Determining the objective purpose (ratio legis) is often a difficult and controversial task. Usually semantic meaning sets the limits of interpretation, but teleological reduction gives the text a meaning that its language cannot bear. Its result is »contra verba sed secundum rationem legis«, therefore it is even more controversial. Argument of teleological reduction claims that legal rule should not be applied when the outcome of application in concrete case is inconsistent with the purpose of the statute. Therefore special caution is necessary when the judge is looking for the purpose of the legal act. The theory speaks about hard cases, which are based on weighing and balancing. In this sense we are not dealing with interpretation, but a doctrine of filling in a gap (lacuna) in a legal text.
In the first part the author in order to define a teleological reduction deals with teleological interpretation and several related well-established canons of interpretation, compers this specific gap with classical normative gap, because this gap is not a genuine normative gap since we are not dealing with the absence of the normative regulation of a given field, but with a gap that appeared as a consequence of our interpretation of the norm (axiological gap). The author draws attention to the importance of this distinction. The last chapter presents the application of the argument in the case law of Slovenian courts. |
