Abstract
Psihopatija je osebnostna motnja, katere izvor ni popolnoma jasen, definicije pa so si med seboj še vedno neenotne. Na forenzičnem področju bi lahko izpostavili Roberta Hara in njegovo PCL-R orodje za klasifikacijo psihopatije. V povezavi s predstavljenimi definicijami preostalih avtorjev in orodji za klasifikacijo jo lahko skupno opredelimo kot motnjo, za katero so značilni antisocialno vedenje in specifične osebnostne lastnosti. V nadaljevanju smo opredelili pojem preiskovalnega intervjuja, ki temelji na gradnji odnosa, njegov cilj pa je pridobitev čim bolj obširnih in zanesljivih informacij, ki bi doprinesle k odkrivanju resnice. Predstavili smo udeležence intervjuja, etiko intervjuvanja, načine primernega postavljanja vprašanj, odkrivanje preslepitve in opisali model PEACE, ki je eden izmed boljših pristopov preiskovalnega intervjuja. V zadnjem poglavju smo se nato navezali na preiskovalni intervju s psihopatom, v katerem smo ugotavljali postavljeno hipotezo, da preiskovalni intervju z nepsihopatskimi in psihopatskimi osumljenci poteka na enak način. To hipotezo smo nato tudi ovrgli. S predstavljenim vedenjem psihopatov med intervjujem, strategijami proti psihopatskem vedenju ter opisom odkrivanja preslepitve in psihopatskih lastnosti med intervjujem smo namreč ugotovili, da preiskovalna intervjuja s psihopatskimi in nepsihopatskimi osumljenci ne potekata na enak način, saj se intervju s prvimi prilagaja glede na njihove lastnosti in ne obstaja ena strategija, ki bi bila uporabna pri vseh enako. Ugotovili smo tudi, da je problem pri intervjuvanju psihopatov ravno uporaba tradicionalnih tehnik, kar smo predstavili na konkretnem primeru, katerega posledica je bila neuspešen intervju.

Psychopathy is a personality disorder; its origins are not entirely clear and its definitions remain discordant. Robert Hare with his PCL-R tool for psychopathy classification is very prominent in the forensic field. In conjunction with the presented definitions of other authors and classifications tools, psychopathy can be defined as a disorder which is characterized by antisocial behavior and specific characteristics. The thesis defines the term investigative interviewing, which is based on building a good relationship with the interviewee. Its goal is to obtain the most comprehensive and reliable information that would contribute to discovering the truth. We presented the participants in the interview, the ethics of interviewing, the ways of appropriate questioning and detecting deception. We also described the PEACE model, which is one of the best approaches to investigative interviewing. The last chapter examines the investigative interview with a psychopath and considers the hypothesis stating that investigative interviewing a non-psychopathic and a psychopathic suspect is carried out in the same manner. That hypothesis was rejected. Considering psychopathic interviewee behaviours, the detection of psychopathic deception and its characteristic during the interview, we concluded that investigative interviewing with psychopathic and non-psychopathic suspects is not carried out in the same manner. Interviews with psychopathic suspects are adjusted to their characteristics and there is no strategy that would fit both types of interviewees. We also established that the problem with interviewing psychopathic suspects is in the use of traditional methods. This was demonstrated with a specific case which had a flawed interview as a consequence. |
