Abstract

Konflikti med označbami geografskega izvora in blagovnimi znamkami so posledica njunih podobnosti in razlik. Obe pravici kažeta na izvor zadevnega proizvoda, vendar označbe geografskega izvora kažejo na geografsko poreklo, blagovne znamke pa razkrivajo komercialno poreklo. Konflikt se pojavlja tudi na mednarodni ravni, saj med državami ni enotne stopnje zaščite, nekatere predvidevajo višjo stopnjo zaščite za označbe geografskega izvora, druge to področje urejajo skupaj z blagovnimi znamkami. V magistrskem delu obravnavamo več situacij, ki se nanašajo na razmerje konflikta med označbami geografskega izvora in blagovnimi znamkami. Najprej konflikt med prejšnjo označbo geografskega izvora in kasnejšo blagovno znamko, nato še konflikt med prejšnjo blagovno znamko in kasnejšo označbo geografskega izvora. Prav tako se dotaknemo področja omejitve pravic iz označb geografskega izvora in blagovnih znamk. Predvidene rešitve posamezne vrste konflikta so predstavljene z vidika Sporazuma TRIPS, v okviru EU se podrobneje osredotočimo na Uredbo 1151/2012, ki ureja področje kmetijskih izdelkov in živil, ter vključimo relevantno sodno prakso Sodišča v Luxembourgu.

Secondary abstract: Conflicts between geographical indications and trademarks come as a result of their similarities and differences. Both intellectual property rights are used for the purpose of distinguishing goods, however geographical indications designate geographical origin of product and trademarks reveal commercial origin. This conflict occurs at the national and international level and since there is no uniform level of protection, some countries provide a higher level of protection for geographical indications than others, there are also countries which regulate area of geographical indications through trademark law. Through thesis we examine situations when a conflict between geographical indications and trademarks could occur. First is the conflict between the earlier geographical indication and later trade mark, then the conflict between the earlier trade mark and the subsequent geographical indication. Lastly, both rights can be a subject of restriction, in such cases owner cannot prevent use from third parties. Adopted solutions are presented in terms of the TRIPS Agreement, acts of EU law, especially Regulation 1151/2012, which regulates the field of agricultural and food products, and relevant case law of the Court in Luxembourg.
