Abstract

Disciplinska odgovornost je odgovornost delavca za kršitve pogodbenih ali drugih obveznosti iz delovnega razmerja. Namen disciplinske odgovornosti z vidika delodajalca je zagotavljanje reda in discipline na delovnem mestu, z vidika delavca, kot šibkejše stranke, pa zavarovanje pred samovoljnimi disciplinskimi ukrepi delodajalca. Zakon o delovnih razmerjih določa, da lahko delodajalec delavcu, ki je spoznan za disciplinsko odgovornega, izreče opomin. Ureditev glede drugih disciplinskih sankcij, ki jih zakon primeroma našteva (denarna kazen, odvzem bonitet idr.), pa pogojuje z ureditvijo v kolektivni pogodbi dejavnosti. Za javne uslužbence, zaposlene v državnih organih in upravah samoupravnih lokalnih skupnosti, pa se glede disciplinske odgovornosti uporabljajo določbe specialnega zakona, Zakona o javnih uslužbencih. Določila specialnega zakona glede disciplinske odgovornosti javnih uslužbencev se uporabljajo za vse javne uslužbence, ki so zaposleni v državnih organih in upravah samoupravnih lokalnih skupnosti, za ostale javne uslužbence pa se glede disciplinske odgovornosti uporabljajo določila Zakona o delovnih razmerjih. Javni uslužbenec odgovarja za lažje in težje kršitve obveznosti, ki jih je storil naklepoma ali iz malomarnosti. Pri opredelitvi disciplinske odgovornosti so pomembni tudi mednarodnopravni viri ter pravno varstvo, ki ga ima delavec na voljo.

Secondary title: Employee's disciplinary responsibility
Secondary abstract: Disciplinary responsibility is given in case the worker does not fulfill the contractual obligations and other commitments from the employment relationship. The intention of disciplinary responsibility from the employer's perspective is to ensure the good order and discipline at workplace; from the perspective of the employee, as a weaker party, it means the protection against arbitrary discipline measures of the employer. The Employment Relationships Act (ZDR-1) states the fact that the employer can declare a warning or notification of the disciplinary sanction to the disciplinary responsible employee by the way of examples (financial penalty, withdrawing bonuses etc.) in case they are specified in the sectoral collective agreement. Disciplinary responsibility is also regulated by the Civil Servants Act (ZJU). ZJU is applied in relation to the ZDR-1 as a special law. The provisions of the ZJU relating to the disciplinary responsibility are applied to all civil servants, employees in state bodies, and local authorities. For the others who are employed in public services the provisions of the ZDR-1 are used. A public employee is responsible for easier and harder infringements of the obligation done intentionally or negligently. In the definition of the disciplinary responsibility there are relevant international sources and legal protection of employee that is available.
