Abstract
Poslovodna oseba mora poskrbeti za svojo socialno varnost. Eden od načinov je vstop v delovno razmerje, ima pa tudi druge možnosti. Poslovodja ni tipičen delojemalec, saj se v podjetju predstavlja predvsem v imenu delodajalca. Predstavljena je pravna in socialna problematika, ki jo prestavlja ta dvojna vloga. Izpostavljena je posebnost enoosebnih družb, problematika neenotne zakonodaje, sodna praksa, primerjava realnega in javnega sektorja. S pregledom načinov obdavčitve in plačevanjem prispevkov za socialno varnost se ugotavlja najprimernejši status poslovodne osebe v podjetju.

Secondary abstract: |
The decision regarding the status of a manager in a company is made upon a manager assuming such function. Labour legislation in Slovenia provides for the possibility of employment under a concluded contract of employment and in this thesis we studied the appropriateness or necessity of such a decision on status. Several research questions are defined in the introduction, followed by definitions and various social situations in the first part. Case law is analysed in the second part, with an emphasis on conflicts between managers and employers in labour court, and a comparison made of taxation and fees incurred depending on the particular status. Based on the explanations of the competent ministry, we attempted to present the problems incurred when holding a managerial status. The results of the research questions are presented in the final part, confirming or disproving our assumptions. |
