Abstract

Postopek osebnega stečaja ima dva namena. Prvi je sorazmerno poplačilo upnikov iz dolžnikovega premoženja in drugi odpust obveznosti, ki dolžniku zagotovi možnost novega začetka. Glede na namen osebnega stečaja, si znotraj postopka stojijo nasproti interesi upnikov in interesi dolžnikov. Namen magistrske naloge je prikazati in analizirati, kako so urejena temeljna vprašanja postopka osebnega stečaja v Sloveniji, ZDA in Veliki Britaniji ter na tej podlagi opraviti primerjalnopravno analizo navedenih pravnih ureditev. Obravnavana so vprašanja glede začetka postopka, stečajne mase, poplačila upnikov, odpusta obveznosti in alternativnih načinov razbremenitve prezadolženosti potrošnikov.

Secondary abstract: The personal bankruptcy procedure has two purposes. The first is proportional repayment to the creditors from the debtor´s property, and the second is the dismissal of obligations which ensures the debtor a new beginning. In accordance with the purpose of the personal bankruptcy, the interests of creditors and debtors stand opposite within the process. The purpose of the master thesis is to present and analyze how the fundamental issues of the personal bankruptcy procedure are regulated in Slovenia, USA and Great Britain and, on that basis, perform a comparative analysis of the previously mentioned regulations. The issues related to the initiation of the procedure, the bankruptcy estate, creditors repayment, debt discharge and alternative methods of relieving the overindebtedness of consumers are discussed.
