Abstract

Zaključna diplomska naloga obravnava problematiko nadurnega dela, ki je pri nas in tudi v tujini zelo razširjena oblika dela. Delodajalci se poslužujejo nadurnega dela kot del fleksibilne oblike razporeditve delovnega časa. Zaposleni v večini primerov nadurno delo opravljajo iz finančnih razlogov, saj naj bi se jim s tem zvišala mesečna plača. Diplomsko delo je razdeljeno na dva dela. V prvem delu smo predstavili, kako je nadurno delo urejeno po mednarodnem pravu ter kakšna je pravna ureditev nadurnega dela po Zakonu o delovnih razmerjih v Republiki Sloveniji. V drugem delu smo s pomočjo anketnega vprašalnika z enostavno opisno metodo opredelili delavčevo poznavanje zakonov na področju nadurnega dela. Iz raziskave je razvidno, da delavci slabo poznajo delovno zakonodajo, ki se nanaša na nadurno delo. Kljub temu pa so se pripravljeni izpostaviti v primeru kršenja pravic.

Secondary abstract: Finishing thesis deals with the issue of overtime work. Overtime work is at home and abroad widespread form of work. Employers making use of overtime work as part of flexible forms of organization of working time. Overtime work is mostly done for financial reasons, because of increased monthly payments. The thesis is divided into two parts. In the first part, we present how the overtime work is regulated under international law, and what is the legal regulation of overtime work under the Employment Relations Act in Slovenia. In the second part, we used a questionnaire with simple descriptive method to identify the worker's knowledge of the laws relating to overtime work. The study shows that workers are unfamiliar with labor law, which relates to overtime work. Nevertheless, they are willing to make a stand in case of violation of rights.
