Secondary abstract: | The thesis presents the basic characteristics of the foundation and regulation of the Anglo-American accusatory-adversarial system of procedural criminal law and provides a historical overview of the Anglo-Saxon model of criminal procedure from its beginnings and development to an insight into the main characteristics of the modern regulation of the adversarial model, which encompasses a description of the structure of criminal procedure in the USA from the investigation of the criminal offence to the final judgment. The last part of the thesis is a comparative description of the main differences between the accusatory-adversarial and the continental European mixed (accusatory-inquisitorial) system of procedural criminal law, concluding with a proposal of changes that the author feels would be worth considering in the further modernization of the Slovenian criminal procedure. |
