Abstract

V svoji diplomski nalogi sem obravnavala področje pravic istospolnih parov v Italiji in Sloveniji. Ta tema mi je kot bodoči pravnici zanimiva predvsem z vidika temeljnih človekovih pravic. Za njihovo zagotovitev in varstvo že od leta 1948 skrbi Splošna deklaracija človekovih pravic, ki jo je sprejela in razglasila Generalna skupščina združenih narodov, na evropskem nivoju pa imamo kar dva pravna akta, Evropsko konvencijo o varovanju človekovih pravic in temeljnih svoboščin v okviru Sveta Evropa ter Listino Evropske unije o temeljnih pravicah za članice Evropske unije. Kljub temu da se jim daje čedalje večji pomen pa ostaja področje pravic homoseksualnih parov še zelo nedorečeno, čeprav ta »pojav« ni nekaj novega. Naklonjenost do istega spola nas spremlja že od nekdaj. Nobena skrivnost ni, da je bil v antični Grčiji in Rimu to celo znak višjega družbenega položaja. Večina evropskih držav že aktivno ureja njihov položaj, zanimiva izjema pa je Italija. Julija 2015 je Evropsko sodišče za človekove pravice v Strasbourgu izdalo sodbo Oliari and Others v. Italy, v kateri je naložilo italijanskemu zakonodajalcu, da mora svojim istospolnim državljanom omogočiti pravno priznane oblike njihovih zvez, ki jim bodo dajale podobne pravice, kot jih imajo raznospolni pari. Da v italijanskem zakonodajnem korposu sploh niso omenjeni, gre pripisati zagotovo vplivu Rimskokatoliške Cerkve in vmešavanju Vatikana v politične debate. Ta sodba je zgodovinski mejnik za pravice lezbične, gejevske, biseksualne in transspolne (v nadaljevanju LGBT) skupnosti v Italiji, njen pomen pa sega tudi do ostalih evropskih držav, tudi Slovenije. Čeprav imamo v Sloveniji že od leta 2005 sprejet Zakon o registraciji istospolnih partnerskih skupnosti, pa je le-ta zelo pomanjkljiv in omogoča, vsaj do sprejetja Zakona o partnerski zvezi, veliko diskriminacije. Namen diplomske naloge je s pomočjo sodbe Evropskega sodišča za človekove pravice predstaviti trenutno stanje pravic homoseksualcev v Italiji in njen pomen za nadaljnji razvoj tega področja. Za lažje razumevanje in primerjavo sem v drugem delu diplome predstavila trenutno in prihajajočo zakonodajo v Sloveniji, ter na kratko prikazala ureditve drugih evropskih držav.

Secondary abstract: The thesis deals with the field of homosexual couples' rights in Italy and Slovenia. As a future lawyer, I am interested in this topic especially in terms of fundamental human rights. The Universal Declaration of Human Rights, adopted and proclaimed by the General Assembly of the United Nations, is in charge of their provision and protection. At the European level, there are two legal acts, the European Convention on Human Rights and Fundamental Freedoms of the Council of Europe, and the EU Charter of Fundamental Rights for the members of the European Union. Despite the fact that more emphasis is given to the scope of the homosexual couples' rights, this field is still very vague, although this »phenomenon« is not something new. The affection towards the same sex accompanies us since time immemorial. It is no secret that in ancient Greece and Rome it was even a sign of a higher social status. Most European countries already actively govern their situation, however, Italy is an interesting exception. In July 2015, the European Court of Human Rights in Strasbourg issued a judgment Oliari and Others v. Italy, where the Italian legislature was ordered to allow the homosexual citizens legally recognized relationships, which will give them similar rights as the heterosexual couples have. Homosexual couples are not even mentioned in the Italian legislative corpus, which can certainly be attributed to the influence of the Roman Catholic Church and the interfering of Vatican in the political debate. This judgment is a historic milestone for the rights of LGBT in Italy and its importance extends to other European countries, including Slovenia. Although the Act on the registration of same-sex partnerships was adopted in Slovenia in 2005, it is very flawed and allows, until the adoption of the Law on partnership, much discrimination. The aim of this thesis is to present, through the judgment of the European Court of Human Rights, the current state of homosexual people’s rights in Italy and its importance for the further development of this field. In the second part of the thesis I presented, for better understanding and comparison, the current and upcoming legislation in Slovenia, and briefly described the regulations in other European countries.
