Abstract

Za človeško družbo je značilno, da se v njej pojavljajo spori.Enega izmed načinov reševanja sporov predstavlja mediacija kot glavni in tipični predstavnik alternativnega reševanja sporov. S sprejetjem Zakona o mediaciji v civilnih in gospodarskih zadevah se je Slovenija pridružila državam, ki imajo zakonsko urejeno mediacijo. Na podlagi Zakona o alternativnem reševanju sodnih sporov pa je mediacija postala tudi del rednega poslovanja slovenskih sodišč. Sodišču pridružena mediacija je edini postopek sodišču pridruženega alternativnega reševanja sporov, ki se izvaja na slovenskih delovnih sodiščih. Magistrska naloga obravnava sodišču pridruženo mediacijo in njeno umestitev med metode alternativnega reševanja sporov, opredeljuje njene temeljne oblike in lastnosti kot tudi njene posebnosti v delovnih sporih. Prav tako predstavlja njen odnos v razmerju do nekaterih procesnih institutov ter polemike v zvezi z njo. Magistrska naloga vsebuje tudi raziskovalni del. Predstavljeni in analizirani so podatki, pridobljeni s pomočjo sodne statistike, evalvacijskega vprašalnika, ankete ter intervjuja. Na osnovi analize teh podatkov magistrska naloga prikazuje, kako se je mediacija uveljavila na slovenskih delovnih sodiščih skozi različne vidike. Ugotovitve so podlaga za razmislek in morebitno izboljšanje mediacije »de lege ferenda«, kar bi lahko bil prispevek k razvoju mediacije.

Secondary title: Solving labour disputes with court-connected mediation
Secondary abstract: For the human society is characterized in that there occur conflicts. One of the ways of resolving disputes presents mediation as the main and typical representative of ADR. With the adoption of the Law on mediation in civil and commercial matters Slovenia joined the countries that have regulated mediation. On the basis of the Law on Alternative Dispute litigation mediation has also become part of the regular operations of Slovenian courts. Court-connected mediation is the only court proceedings associate ADR, which is carried out on the Slovenian labor courts. Master's thesis deals with court-connected mediation, its placement between the methods of alternative dispute resolution, defines its basic shape and characteristics, as well as its peculiarities in labor disputes. It also represents her attitude in relation to certain procedural institutions and controversy attached to it. Master's thesis contains also a research component. The judicial statistics, evaluation questionnaires, surveys and interviews are presented and analyzed. Based on analysis of these data master's thesis gives an overview of the current situation of court-connected mediation in the Slovenian labor courts through various aspects. The findings provides a basis for reflection and could provide improvement of mediation "de legeferenda,” which contributes to the development of mediation.
