Abstract

Pod naslovom »Izbrana problematika upravljanja večstanovanjskih stavb s pregledom aktualne sodne prakse« sta za razumevanje razmerij med glavnimi udeleženci posla upravljanja z večstanovanjskimi objekti najprej opredeljena glavna udeleženca posla – upravnik in etažni lastnik. Za njuno razmerje je ključno zastopanje – upravnik je zakoniti zastopnik etažnega lastnika oz. lastnikov skupnih delov in naprav v objektu, ki ga imajo v solastnini. Skozi glavne predpise in sodno prakso so predstavljeni nekateri izbrani problemi in dileme, s katerimi se upravnik pri svojem delu srečuje: legitimacija upravnika v sodnih postopkih, upravnikovo deljenje obveznosti med etažne lastnike, pravna narava posameznih vrst plačil, ki jih etažni lastnik izvaja in izterjava v primerih neplačil, problemi v implementaciji podzakonskih predpisov glede na pogodbo o medsebojnih razmerjih in drugi problemi iz prakse. Predstavljene bodo tudi nekatere posebnosti etažne lastnine – pravice in bremena, ki jih etažnim lastnikom prinaša etažna lastnina: zakonito stvarno breme, predkupna pravica, izključitvena tožba. Na koncu sta predstavljeni še dve izbrani temi iz obširnega področja stanovanjskega prava: razmerja, ko je v stanovanju (v večstanovanjskem objektu) najemnik in vloga upravnika pri dokončanju vpisa etažne lastnine.

Secondary abstract: Under the title “Selected problems with management of apartment buildings through overview of current court decisions” and for the understanding of the management of apartment buildings business there are, in the first place, mentions of two major participants: apartment building manager and condominium owner. The key to their relation is representation – apartment building manager is by law a representative of each condominium owner, or more accurately, a representative of each owner of common parts and appliances in the building which they together own as condominium. Through the main legislative and current court decisions there are some selected problems and dilemmas presented here, which apartment building manager encounters daily: his litigation legitimation, his cost sharing between condominium owners, legal nature of specific types of cost payments which condominium owner makes and the recovery in cases when he fails to make them, problems with implementation of executive regulations due to contract of mutual relationship between condominium owners and other problems as seen in the field. Also some specifics of condominium ownership will be presented – the rights and the burdens which condominium brings to condominium owners: by-law property encumbrance, pre-emptive right, deprivation action. There are two more themes from the extensive field of apartment law presented at the end: relationships when a tenant (in a multi apartment building) is using the apartment and the role of the apartment building manager within finishing Land Registry entry of condominium.
