Abstract
Magistrska naloga proučuje slovenski sistem množičnega vrednotenja nepremičnin z vidika pravne varnosti lastnika nepremičnin. Sistem množičnega vrednotenja je v Sloveniji sicer operativen, vendar pa je njegova uporaba trenutno okrnjena zaradi odločitve Ustavnega sodišča RS o neizpolnjevanju ustavno varovanih standardov pravne varnosti. Pravno varnost posameznika zagotavlja spoštovanje načela pravne države. Za ta namen mora država poskrbeti za jasne, nedvoumne, razumljive in nomotehnično brezhibne predpise. V vsakem posameznem primeru morajo biti odločitve vsebinsko pravilne in ustrezno postopkovno varovane. Sistem množičnega vrednotenja je postopek, v katerem se nepremičninam oceni njihova tržna vrednost. Pri tem se kot orodje uporabijo modeli množičnega vrednotenja, ki jih oblikuje Geodetska uprava Republike Slovenije na podlagi ugotovitev spremljanja trga nepremičnin. Individualno vrednost vsake posamezne nepremičnine nadalje določajo podatki o lastnostih le te, ki so sistematično zbrani in vpisani v uradne evidence preko sistemu evidentiranja nepremičnin. Tako oblikovana posplošena tržna vrednost je večnamenski podatek in se uporablja za različne javne in zasebne namene, tudi za davčne namene in v postopkih ugotavljanja upravičenosti do pravic iz javnih sredstev. Prav v teh dveh vrstah postopkov pa so standardi pravne varnosti najvišji in varovani že na ustavnem nivoju. Sistem množičnega vrednotenja mora torej najvišjim standardom pravne varnosti zadostiti le za določene namene uporabe. Kljub temu se je pokazalo, da je primerno enotno urediti sistem množičnega vrednotenja za vse namene, saj se le tako lahko učinkovito zagotavlja večnamenska uporaba podatka o posplošeni tržni vrednosti. Mednarodni sistemi najboljših praks ne ponujajo enotnih in neposredno uporabnih rešitev glede zagotavljanja pravne varnosti, saj je potrebno rešitve sistemsko umestiti v že veljaven upravni sistem v Republiki Sloveniji. Pri tem je treba upoštevati tako značilnosti postopka množičnega vrednotenja kot tudi njegovo neločljivo povezanost s sistemom zbiranja podatkov o nepremičninah. Analiza elementov zagotavljanja pravne varnosti lastnikov nepremičnin je predstavljena z materialnopravnega in postopkovnega vidika, pri katerih so izpostavljena odprta vprašanja ter predlagane rešitve za izboljšave. Zaključna ugotovitev magistrske naloge je, da sistem množičnega vrednotenja v Sloveniji vsekakor potrebuje nadgradnjo v smislu povečanja pravne varnosti posameznika, vendar pa je potreba po spremembah le delna in realno izvedljiva.

Legal safety of the owner of real property in mass valuation system of real property |

This thesis examines the questions of legal safety of an owner of real property in Slovenian system of mass valuation of real property. The system in Slovenia is functional but its use has been limited by the Constitutional court decision. The rule of law ensures legal safety of each individual. In this respect the state authority has to provide clear, unambiguous, understandable and nomo-technically flawless rules. According to these rules the decisions should be of correct in each individual case and the individual should have the right to review and appeal each decision. System of mass valuation of real property produces an estimation of market value of real property. As a tool special valuation (CAMA) models are used which are determined by the Surveying and Mapping Authority of Slovenia according to the development of real property market. Each individual value of real property depends on the data that is systematically collected and registered about each property. Generalized market value is used for different public and private/business purposes; also as a tax base or as a tool to determine the material status of applicant for social benefits. In these cases in particular the standards for legal safety are extremely high and guarded by the Constitution. The highest standards of legal safety should be respected in mass valuation system only for certain purposes. However it has been determined that the system should be regulated in uniform way in order to efficiently guarantee multi-purpose use of the system. International best practices do not offer uniform in directly usable solutions since each new procedure should be systematically placed in already functional administrative system of Slovenia. Doing so, technical features of mass valuation system and features of data collecting system should be respected as well. Analysis of the elements that guarantee legal safety is made according to material and procedure point of view. In both cases open questions and possible solutions are being discussed. The conclusion of the thesis is that Slovenian mass valuation system of real property needs some improvement to achieve the constitutional standards of legal safety of the owner of real property however the changes required only in some areas of the system and can be implemented in real time. |
