Abstract

Elektronska zemljiška knjiga predstavlja bistveno prenovo sistema za vpisovanje pravic in predlaganjem predlogov v zemljiško knjigo. Ta sistem prinaša predvsem veliko prednosti, ker pa sem s sistemom seznanjena tudi na svojemu delovnem mestu, vem, da se predvsem kvalificirani uporabniki pri delovanju elektronske zemljiške knjige srečujejo z marsikatero slabostjo. Težave se pojavljajo tako pri različnih odločitvah sodišč, interpretacij zemljiško knjižnih referentov in neprilagojenosti samega sistema, predvsem pri napačno vpisanih pravicah, bodisi, da je do tega prišlo zaradi napačnega predlaganja zemljiškoknjižnega predloga, zaradi zmote zemljiško knjižnega sodišča ali pa pri prepisu/prenosu podatkov iz fizično vodene zemljiške knjige. Nadalje je skoraj nemogoče priti do odgovora ali pomoči v primeru tehničnih težav, saj je tehnična podpora, ki je namenjena pomoči uporabnikom, zelo počasi odzivna, kar privede predvsem do težav, ko je treba določeno pravico ( npr. hipoteko) zaradi nadaljne realizacije pravnega posla čimprej vknjižiti v zemljiško knjigo.

Secondary abstract: Electronic land registry represents a major overhaul of the system for registration of rights and proposing suggestions in the land registry. This system brings mainly advantages but because I am familiar with using the system at my workplace I know that especially qualified users are faced with many weaknesses on the operational level of the electronic land registry. Problems occur both in the various court rulings, interpretations of the land registry clerks and the lack of flexibility of the system itself, especially with the misspelt rights, either that this has occurred due to the incorrect proposing of a land registry proposal, due to an error of the land registry court or with the copy/transfer of the data, out of the land registry in psyhical form. Furthermore, it is almost impossible to get a response or assistance in case of technical problems as the technical support designed to help the users is very unresponsive, leading mainly to problems when a right (eg. Mortgage) needs to be accounted for in the land registry in order to complete the transaction as soon as possible.
