Abstract

Magistrsko delo preučuje vprašanja v zvezi z institutom podeljene sposobnosti biti stranka v sodnih postopkih, ki je sicer urejen v Zakonu o pravdnem postopku (Uradni list RS, št. 26/1999 – v nadaljevanju: ZPP). Sodišču omogoča, da s pravnim učinkom v določeni pravdi, prizna lastnost stranke obliki združevanja, ki sicer nima sposobnosti biti stranka pred sodiščem. Ti subjekti, na podlagi podeljene sposobnosti biti stranka, v postopku pred sodiščem nastopajo kot tožeče, ali kot tožene stranke. Obliki združevanja to sposobnost podeli sodišče, pred katerim je postopek sprožen. Sposobnost biti stranka je ena od procesnih predpostavk, od katerih obstoja je odvisna dopustnost postopka pred sodiščem. Na procesne predpostavke pazi sodišče po uradni dolžnosti, ves čas postopka. Ko sodišče ugotovi, da določena oblika združevanja, ki želi nastopati pred sodiščem, nima sposobnosti biti stranka, mora presoditi, ali izpolnjuje glavne pogoje, da se ji ta sposobnost lahko podeli. Pri tem mora paziti predvsem na to, da bo mogoče v tem postopku sprejeto sodno odločbo, v morebitnem poznejšem izvršilnem postopku, tudi izvršiti. Namen instituta je varstvo pravic udeležencev pravnega prometa, ki se oblikam združevanja zagotavlja s tem, da se jim omogoča uveljavljanje njihovih pravic pred sodiščem, ostalim udeležencem pravnega prometa pa s tem, da pred sodiščem lahko uveljavljajo svoje pravice nasproti takšnim oblikam združevanja. Naloga sodišča pri tem je, da poskrbi, da bo to varstvo tudi učinkovito.

Secondary abstract: Master's thesis examines the issues related to the institute of awarded capacity to be a party in legal proceedings, which is governed by the Civil Procedure Act. This institute allows Court, to recognize the characteristics of the party in certain litigation, to the form of the association, which usually does not have the capacity to be a party in legal proceedings. These entities, on the basis of awarded capacity to be a party in proceedings, are acting before a court as applicants or as defendants. Form of association is this ability granted by a court, before which the proceedings were brought. The ability to be a party, is one of the procedural requirements, of which existence, the admissibility of the case before the court is dependent. On the procedural prerequisites, watches the court in its own motion, throughout the procedure. If the court determines, that some form of association, that wants to appear before the court, does not have the capacity to be a party, must assess whether it meets main conditions, that this ability can be granted. It must take particular care, that the judgement accepted in this case, later in subsequent enforcement proceedings, can also be executed. The purpose of the institute is to protect the rights of participants in legal transactions, which are forms of association guaranteed, thereby enabling them to exercise their rights before a court, and the remaining participants in legal transactions, by enabling them before the courts to assert their rights against such forms of association. The Court's task here is to ensure, that this protection is also effective.
