Abstract

Sovražni govor je govor, ki je uperjen proti različnim manjšinam na podlagi barve kože, etničnosti, vere, spolne usmerjenosti, narodnosti ter ostalimi skupinami ljudi. Takšen govor je povezan s predsodki, stereotipi in diskriminacijo. Na drugi strani pa imamo svobodo izražanja, ki je ustavno varovana pravica in ena izmed temeljnih človekovih pravic. Pomeni, da lahko vsakdo svobodno izbira, sprejema in širi vesti in mnenja. Kljub temu, da gre za ustavno varovano pravico, pa ta ni absolutna, temveč je omejena s pravicami in svoboščinami drugih. Definicija sovražnega govora je še vedno precej nejasna, saj se nemalokrat definira precej široko. V diplomski nalogi sem obravnavala razliko med neprimernim, nesprejemljivim in kaznivim govorom, med katerega sodi tudi sovražni govor. Kaznivi sovražni govor opredeljuje 297. člen Kazenskega zakonika. Pravico do svobode izražanja je mogoče omejiti le takrat, kadar za to obstajajo utemeljeni razlogi. Do tega pride zlasti takrat, ko se s pravico do svobode izražanja posega v čast in dobro ime drugega ter v pravico do zasebnosti. Pravica do svobode izražanja je lahko omejena le takrat, kadar se upošteva določen javni interes, ki pa mora biti nad interesi posameznika. Presojanje ali je šlo v določenem primeru za poseg v pravico do svobode izražanja je ena izmed zahtevnejših nalog.

Secondary abstract: Hate speech is a speech, which insult a group on the basis of color, ethnicity, religion, sexual orientation, national origin, and other social group. Such speech is linked to prejudice, stereotyping and discrimination. Freedom of speech is a right protected by constitutional and one of the most fundamental human rights, which contains freedom of contains, freedom of accepting and giving opinions and ideas. The freedom of speech is not an absolute right and can be limited when it conflicts with other rights. In the thesis a distinction is made between inappropriate, unacceptable type of communication and communication as a criminal offense, which includes hate speech, as defined by article 297 of the Slovenian Penal Code. Freedom of speech can be limited when different conditions are fulfilled. This often happens when freedom of speech is carried out in a way, which interferes with the right to personal integrity and right to privacy. Freedom of speech can be limited only, when this is very important for protecting the public or affected the individuals.
