Abstract

V diplomski nalogi je obravnavana tematika, ki se nanaša na načelo enakopravnost zakoncev, zunajzakonskih partnerjev in istospolnih partnerjev ter na področja, ki so zajeta v tem načelu. Načelo enakopravnosti je splošno načelo civilnega prava, ki je določeno v Zakonu o zakonski zvezi in družinskih razmerjih. Na področju zakonskega in družinskega prava določa, da imata zakonca v zakonski zvezi enake možnosti za porazdelitev pravic. Velja tako za osebna razmerja, kot za premoženjska razmerja med njima, uresničuje pa se tudi pri razvezi zakonske zveze. Ker je teorija eno, resnično, vsakdanje življenje pa drugo, na koncu diplomske naloge izdelan anketni vprašalnik prikazuje, ali partnerji skupaj odločajo o vseh pomembnih zadevah, ali pa prevladuje dominanten spol, ki odloča o vseh zadevah sam, o katerih bi morala skupno in soglasno odločati oba partnerja. V diplomskem delu je predstavljena tudi Islamska republika Iran, ki nima urejene enakopravnosti med spoloma in s tem tudi med zakoncema v veljavno sklenjeni zakonski zvezi. Iran je zanimiv zaradi tega, ker je skozi zgodovino razvil različne oblike zakonskih zvez, danes pa se še vedno uporablja začasna zakonska zveza, ki je sklenjena s točno določenim namenom (na primer prikritost nezvestobe moškega) in je nam nekoliko tuja. Pojavil pa se je tudi iranski feminizem, ki je že dosegel določene premike v smeri enakopravnosti med spoloma.

Secondary abstract: The bachelor's thesis covers the topic which relates to the principle of spousal equality, extramarital partners and same-sex partners, as well as the fields covering this principle. The principle of equality is a general principle of civil law which is arranged with the Marriage and Family Relations Act. In the field of marriage and family law, it stipulates that spouses have equal possibilities for the distribution of rights. It applies to personal and proprietary relations between the spouses, as well as to the process of dissolution of the marriage. Since theory is one thing and real everyday life another, the survey questionnaire enclosed at the end of the bachelor's thesis reveals whether the partners jointly decide on all important matters or whether the dominant gender prevails and decides on all matters on its own, even though both spouses ought to decide on them jointly and unanimously. Furthermore, the bachelor's thesis presents the Islamic Republic of Iran which has not implemented the principle of gender equality, nor the principle of spousal equality in a legally concluded marital relationship. Iran is also interesting because throughout history, it has developed different types of marital relationships, but today it still uses a temporary marital relationship which is concluded with a definite purpose (for example, to cover a man's infidelity) and seems a bit strange to us. However, with the occurrence of Iranian feminism, certain shifts have occurred in relation to gender equality.
