Abstract

V diplomskem projektu smo analizirali pristojnosti Državne revizijske komisije v zvezi s postopki javnega naročanja v Republiki Sloveniji in na Hrvaškem. Z izdajo novega Zakona o javnem naročanju, ki je prišel v veljavo s 1. aprilom letošnjega leta, smo pridobili na področju te zakonodaje določene novosti, zaradi katerih bi se naj poenostavila uporaba zakona in zagotovila večja učinkovitost. Prav tako je ZJN-3 združil dve pomembni področji javnih naročil, in sicer splošno področje in infrastrukturno. Ker Državna revzijska komisija kot samostojen organ, nosi veliko odgovornosti, je velikokrat izpostavljena kritikam javnosti, da s svojim delom (predvsem zaradi povprečnega časa odločanja o sporih) zavira nemoteno delovanje postopkov javnih naročil. Skozi analizo smo ugotovili, da je področje pravne zaščite precej podobno zakonodaji v Republiki Hrvaški, že zaradi tega, ker je prav tako članica EU, in te države morajo upoštevati enake direktive. Ker z javnimi naročili zagotavljamo nemoteno delovanje in oskrbovanje javnega sektorja, morajo naročniki delovati gospodarno in v skladu z zakonodajo. Le na tak način se bo zagotovila uspešnost delovanja sistema javnih naročil in čim manj nepravilnosti v postopkih oddaje.

Secondary abstract: In my diploma, we analyzed the competences of the National Review Commission in connection with the procurement procedures in the Republic of Slovenia and Croatia. With the release of the new Public Procurement Act, which came into force on 1 April this year, we have gained in the field of law, certain developments which would be to simplify the application of the law and ensure greater efficiency. ZJN-3 also put together two important areas of public procurement, namely the general area and infrastructure area. Because is National Commission an independent authority, carries a lot of responsibilities, therefore it is often exposed to criticism from the public, that with their work ( mainly due to the average time deciding on conflicts) inhibits the smooth operation of public procurement procedures. Through analysis, we found that the scope of legal protection quite similar legislation in the Republic of Croatia, already because it is also a member of the EU and these countries must take account of the same directive. As public procurement ensures smooth operation and maintenance of the public sector, contracting authorities must act economically and in accordance with the law. Only in this way will ensure the successful operation of the procurement system and minimize irregularities in the procedure.
