Abstract

Sodobne tržne razmere v današnji postmoderni družbi terjajo nagli tok sprememb. Tržni subjekti so primorani v želji po maksimiziranju dobička in minimiziranju izdatkov svoji dejavnosti na tržišču prilagajati tudi svoje zaposlene, tako po številu le teh kot tudi glede na njihovo izobrazbeno strukturo. Prav zaradi velikega števila tržnih subjektov in nenehno spreminjajočega se povpraševanja po določenih izdelkih in storitvah so tržni subjekti dandanes primorani bolj kot kdaj koli prej v racionalizacijo delovne sile. Glede na vse omenjeno v prejšnjem odstavku so t.i. klasične oblike zaposlovanja za sodobne tržne subjekte preveč toge. Pojavila se je potreba po delovni sili, ki je strokovno usposobljena, dinamična glede zaposlovanja in odpuščanja, ter hitro dostopna za uporabnika. Nastalo vrzel na strani povpraševanja po novodobni delovni sili so zapolnile zaposlitvene agencije, ki predstavljajo »bazen« dinamične delovne sile. S tem diplomskim delom prikazujem značilnosti ureditve zaposlovanja pri zaposlitvenih agencijah v Republiki Sloveniji in Republiki Avstriji. Razvidno postane, da so zaposlitvene agencije bistveno olajšale poslovanje tržnih subjektov, kot tudi pospešile zaposlovanje brezposelnih oseb. Razvidna pa postane tudi druga plat te novodobne delovnopravne tvorbe, ki ponekod skriva tudi temno stran sodobnega zaposlovanja. Govora je o kopici najrazličnejših kršitev tako delovnega, socialnega, kot tudi davčnega prava. Prav omenjene kršitve pa ponekod za seboj potegnejo tragične usode napotenih delavcev in njihovih družin, ki se na podlagi omenjenih nepravilnosti komaj da preživljajo ali pa ostanejo celo praznih rok. Te zgodbe mečejo tako temno luč na zaposlitvene agencije in njihov nagli razvoj.

Secondary abstract: Modern market situation in today`s postmodern society demands fast changes. Market operators, desiring to maximize their profits and minimize expenses at their business, are forced to adapt their employees by number and their educational structure. Especially because of a large number of market operators and a constant changing demand for specific products and services, market operators are nowadays forced to rationalize labour force more than ever. Regarding all mentioned in the previous paragraph, the so-called traditional forms of employment are too rigid for the modern market operators. A need for a labour force that is professionally qualified, dynamic regarding hiring and dismissing, and readily accessible to a user has appeared. The resulting gap in the side of a demand for the modern labour force is filled by employment agencies, which represent »a pool« of dynamic labour force. This thesis shows the characteristics of employment regulation at employment agencies in the Republic of Slovenia and the Republic of Austria. It becomes evident that the employment agencies have significantly eased commerce of market operators and they have stimulated the employment of the unemployed people as well. Another thing that becomes evident is the other side of this modern labour formation, which sometimes includes disadvantages of the modern employment. Working, social, tax law and a wide range of several other violations are mentioned. The above mentioned violations sometimes leave tragic consequences for posted workers and their families, which as a result of these violations, barely make their living or even remain empty-handed. These stories are therefore causing a bad reputation for employment agencies and their fast development.
