Abstract
Diplomsko delo se dotika različnih ločenih področij: intelektualne lastnine in njene umestitve v zakonodajno polje, tehnoloških sprememb s posledicami, ki jih nosijo, glasbe same kot svojevrsten kulturni pojav ter najpomembneje, nezaobidljivo povezanost in soodvisnost vsega omenjenega v današnji stvarnosti.
Pojav digitalnih tehnologij, še posebej internet, je zabrisal tradicionalne vloge in odnose med ustvarjalci, založniki in uporabniki. V veljavo so prišle nove platforme z novimi načini distribucije in promocije glasbenih del, obenem pa je digitalna tehnologija spremenila ekonomijo kopiranja in povzročila vzpon spornega vzorčenja in deljenja datotek. Z omenjenim so se spremenile ustaljene poslovne prakse glasbenih industrij in danes se beleži visoko porast digitalne prodaje glasbe. Internet s svojo globalno razširjenostjo in razpršenostjo predstavlja izziv za niz obstoječih pravnih konceptov znotraj avtorskega prava. Pojavljajo se tehnologije kontrole dostopa, ki jih uporabljajo proizvajalci, založniki in nosilci avtorskih pravic z namenom, da omejijo uporabo digitalnih naprav ali informacij, na drugi strani pa nove možnosti izkoriščajo tudi avtorji, ki želijo izkoristiti digitalno tehnologijo in internet za deljenje svojih del na način, da se odpovedo delu svojih upravičenj, da bi dela svobodneje krožila med uporabniki.

This diploma thesis deals with multiple separate areas: intellectual property and its status in legislation, technological changes and their consequences, music itself as a unique cultural phenomenon and, most importantly, the unavoidable connection and interdependence that now exist between all of the aforementioned areas.
The emergence of digital technologies, in particular the Internet, has blurred the traditional roles and relations between creators, publishers and consumers. New platforms have introduced new approaches to distribution and promotion of music, while digital technology has advanced the economy of reproduction and caused disputes with the rise of file sampling and sharing. As a consequence of the aforementioned developments, the music industry has adapted its business practices, and a high growth in digital music revenue is now being observed. The global prevalence of the Internet presents a challenge to a range of existing legal concepts within copyright law. Producers, publishers and copyright holders are applying brand-new access control technologies in order to limit the use of digital devices or restrict access to certain information, but on the other hand the authors themselves are making use of digital technology and the Internet as well, giving up some of their rights but allowing their works to spread themselves more freely throughout the public. |
