Abstract

Klasično vojskovanje med suverenimi državami se v zadnjih desetletjih umika drugačnemu tipu vojskovanja, za katerega se še vedno ne moremo ali ne znamo dokončno uskladiti, kakšne značilnosti kaže, kaj šele, da bi jasno določili pravne norme, po katerih naj bi se ravnali akterji v takemu konfliktu. Tako imenovane "nove vojne" se po vsebini in obliki razlikujejo od klasičnih vojn oziroma oboroženih konfliktov. Spremembe v akterjih, ciljih, načinih financiranja in metodah vojskovanja so empirično dokazljive. Skupni imenovalec sodobnega vojskovanja so elementi asimetričnega konflikta, ki veljavnim pravnim okvirjem in načelom vojskovanja dajejo novo dimenzijo. Virov mednarodnega prava oboroženih spopadov ni malo, vendar je potrebna njihova revizija, saj kljub obsegu trenutno ne morejo zajeti vseh situacij, ki se pojavljajo v sodobnih asimetričnih oboroženih konfliktih. Za tovrstne konflikte je značilno, da vsaj eden izmed akterjev ne upošteva normativnih pravil vojskovanja, saj mu to prinaša ključno prednost pred nasprotnikom, ki je zavezan pravila in norme spoštovati. Rečemo lahko celo, da šibkejša stran v asimetričnem vojskovanju ne more upoštevati pravil vojskovanja, ker bi to vodilo k njenemu porazu. To je samo eden izmed argumentov, ki kažejo na to, da je asimetrično vojskovanje v svojih pojavnih oblikah v večini primerov v nasprotju s tradicionalnim dojemanjem vojskovanja — tudi s pravnega vidika. Ohranjanje ravnovesja med doseganjem vojaških ciljev ob hkratnem spoštovanju humanitarnih norm in človekovih pravic je izjemno pomembno. Zato je potrebno v tem kontekstu v okviru obstoječih pravnih norm veliko pozornost posvečati tudi pravnemu vidiku načrtovanja in vodenja bojnih operacij.

Secondary title: Law of armed conflicts in the circumstances of asymetrical warfare
Secondary abstract: Classic warfare between sovereign states is yielding to a different kind of warfare for which we cannot yet ascertain what its properties are or define clear norms according to which the participants in such a conflict should act. The so called "new wars" are reflecting clear distinction regarding classical wars in terms of form and essence of warfare. Changes in the areas of actors, goals and methods of warfare are evident also through empirical analysis. Common ground of modern conflict is so called asymmetrical warfare, which has been known to put a new perspective on legal principles and framework of warfighting, especially becaouse of its more and more frequent manifestation across the modern theaters of war. The sources on international law regarding armed conflicts are plentiful although there is an obvious need for their revision becaouse positive international law cannot encapsulate every situation that arises to in the new wars, especially those that are characterized by asymmetric conflict. One of the defining characteristics of such conflicts is that at least one of the involved sides does not follow the normative rules of warfare; or rather it exploits them as it brings it an advantage over the rule-bound enemy. We can step forward with the allegation that the weeker side in the asymmetrical conflict should not follow the legal norms as this would be a probable cause of its defeat. Previously mentioned statement is only one of the arguments pointing out that asymmetrical conflict through its manifestations is in opposition with the traditional perception of warfare, including law aspect. Delicate balance between military objective and humanitarian norms should be permanently maintained. To achieve this within existing legal framework a thorough attention must be set on legal aspect of planning and conduct of the operations.
