Abstract
Diplomsko delo se osredini na predstavitev nasilja v družini kot splošnega družbenega problema. Tj. z vsemi svojimi specifikami in s pojavnostjo, zaradi česar zahteva posebno obravnavo. V kontekstu učinkovitega reševanja problematike so predstavljene pristojnosti in vloga različnih institucij in organov. Prav tako je predstavljen ukrep prepovedi približevanja po Zakonu o nalogah in pooblastilih policije (v nadaljevanju ZNPPol).
S tega gledišča se je v zadnjih letih spreminjala zakonodaja na področju nasilja v družini. S strateškega vidika predstavlja spremembo Resolucija o nacionalnem programu preprečevanja nasilja v družini 2009–2014 (v nadaljevanju ReNPPND0914). Nadalje uveljavitev Zakona o preprečevanju nasilja v družini (v nadaljevanju ZPND) z ostalimi spremembami zakonodaje o pristojnosti posameznih organov. Pri preprečevanju in obravnavi nasilja v družini so pomembni številni podzakonski akti – pravilniki, ki zelo natančno definirajo obveznosti različnih organov pregona in ostalih institucij.
Pri obravnavi nasilja v družini in izreku ukrepa prepovedi približevanja določeni osebi in kraju je potrebna velika mera znanja. Potrebne so taktnosti in tudi strokovnosti pri izvedbi policijskega postopka. Ravno ukrep prepovedi približevanja omogoča žrtvi nasilja v družini, da se »spočije« od tega dejanja. V časovno določenem roku, v katerem policisti (ali kasneje tudi preiskovalni sodnik) prepovejo storilcu približevanje žrtvi, ta pridobi ustrezno socialno podporo. Pri tem tudi razmisli in ugotovi, kako lahko uspešno prepreči ponovitveno dejanje.

The thesis deals with domestic violence as a general social issue with specifics and occurrence and which calls for special treatment. It presents the role and competence of different institutions and bodies that are crucial for effective resolution of such issues, and provides insight into the restraining order in line with the Police Tasks and Powers Act.
The legislation pertaining to domestic violence has been changing in recent years: strategically, with the Resolution of National Programme of Family Violence Prevention 2009-2014, and then with the implementation of the Family Violence Prevention Act and other changes to legislation on the competence of individual bodies. In preventing and handling domestic violence, a number of statutory instruments (rules) are also important because they provide more detailed definitions of the obligations of different law enforcement authorities and other institutions.
Police procedures that involve handling domestic violence and serving restraining orders so a perpetrator keeps a certain distance from a person or place require extensive knowledge, tactfulness and professionalism A restraining order can help the victim of domestic violence to "take a break" from the acts, acquire adequate social support and think about how to prevent the same act from happening again. During that time frame, the police or subsequently the investigating magistrate can instruct the perpetrator to keep a certain distance away from the victim. |
