Abstract
Tehnologija je postala del naših življenj. Mobile Health, mobilno zdravje oziroma mZdravje, je del eZdravja, ki je že zaživel pri nas in se postopoma širi po državi. mZdravje je zelo pomembno za naše zdravje, za naše sodelovanje pri zdravljenju, aplikacij mZdravja pa je tudi vedno več na našem tržišču in v bolnišnicah. Pacienti v aplikacijah mZdravja niso lastniki svojih osebnih podatkov, podatkov o zdravstvenem stanju. Vendar je uporaba in druga obdelava pacientovih občutljivih osebnih podatkov izven postopkov zdravstvene oskrbe dovoljena le z njegovo privolitvijo. Zaradi preobsežnih privolitvenih obrazcev v aplikacijah mZdravja, ki jih pacienti ne berejo in ne razumejo, prihaja do zelo velikega posega v ustavno pravico do zasebnosti pacientov.

Technology has become part of our lives. Mobile Health, mHealth is a part of eHealth, which has already come to life in our country and gradually spread throughout the country. mHealth is very important for our health, for our participation in treatment. More and more mHealth applications are in markets and in hospitals.Patients in applications mHealth do not own their personal data, data on health status.
However, the use and other treatment of the patient's sensitive personal data outside the care processes is permitted only with his consent. Due to excessive consents in applications mHealth which patients do not read and do not understand, it could happen a very significant interference with the constitutional right to privacy of patients. |
