Abstract

V magistrskem delu smo preučevali različne regulatorne sisteme gojenja konoplje. Zanimalo nas je, kako pravni sistemi posameznih držav regulirajo konopljo in kako se pri tem prilagajajo mednarodnim pogodbam. Preučevanje je potekalo na podlagi študija različnih virov. Spoznali smo različne regulacije posameznih držav in njihove potencialne prednosti ter slabosti. Rezultat preučevanja je predlog za vpeljavo posamičnih pravnih regulacij na Slovenskem in predvidevanje posledic ter morebitnih težav ob vpeljavi takšnega sistema. Glavni cilj naloge je bila izdelava predloga za regulacijski sistem gojenja konoplje v Sloveniji. Prišli smo do zaključka, da bi za legalizacijo po vzoru ameriških držav bila potrebna dolgoročna strategija. Vsaka oblika legalizacije bi bila v neskladju s podpisanimi mednarodnimi pogodbami in posledično tudi z Ustavo Republike Slovenije, zato bi pred večjimi pravnimi spremembami bilo potrebno spremeniti Ustavo ali pa rešiti problem na mednarodnem nivoju. Najenostavnejša rešitev na mednarodnem nivoju bi bila reklasifikacija konoplje.

Secondary abstract: The thesis deals with different regulatory systems of cannabis cultivation. We were interested in how these systems regulate cannabis cultivation and how they adapt to boundaries of international treaties. The research was carried out using different sources. We analysed different approaches to cannabis regulation and potential strengths and weaknesses of different systems of several countries. Our study results in providing suggestions for an implementation of other country's regulatory systems into Slovenian system and also predicts possible consequences and problems of such implementation. Our main goal was to devise a regulatory system for cannabis cultivation in Slovenia. We came to a conclusion that legalization as seen in the Americas requires a well-planned approach. However, any form of legalization would violate the international treaties that Slovenia has signed, as well as the Slovene constitution. Before any changes are made, a change in either constitution or in the international approach to cannabis cultivation is needed. The simplest solution on the international level would be a reclassification of cannabis.
