Secondary title: | SPECIFIC PERFORMANCE - COMPARISON OF CISG AND THE CODE OF OBLIGATIONS |
Secondary abstract: | The Contract of sale is the most common legal deal in international bussines. In 1980 the Vienna Convention was accepted in order to remove the differences between national laws, involving the Contract of sale. Slovenia has been using it since it's indepedance and therefore uses two forms of contract of sale – national and international. The Vienna Convention unified civil and common law acts, but since Slovenia uses civil law, there are differences between the Contract of sale by the Vienna Convention and the Code of Obligations. In my diploma I will study specific performance in detail and point out all the similarities and differences between the two. |
