Abstract
V diplomskem delu je predstavljena zakonska ureditev različnih načinov vzpostavitve zemljiškoknjižne listine, ki zajema celosten pregled teorije, s poudarkom na pregledu in analizi primerov aktualne slovenske sodne prakse glede posameznih načinov vzpostavitve zemljiškoknjižne listine. V uvodu diplomsko delo opredeljuje zemljiškoknjižno pravo, obširneje obrazloži temeljna zemljiškoknjižna načela ter vknjižbo kot institut, ki je v sistemu zemljiškoknjižnega prava osrednjega pomena za nastajanje stvarnih pravic na nepremičninah. V nadaljevanju so opisane listine, ki pridejo v poštev kot podlaga za vknjižbo v zemljiško knjigo in morajo izpolnjevati stroge zakonske pogoje. Tako vknjižba v zemljiško knjigo brez formalno popolne listine ni mogoča, zato je v tem primeru za pridobitev stvarne pravice nujno potrebno vzpostaviti listino, ki je primerna za vknjižbo, da se doseže cilj, to je vzpostavitev pravnega temelja za prenos stvarne pravice ter vknjižba v zemljiško knjigo.
V osrednjem delu diplomskega dela so predstavljeni različni načini vzpostavitve zemljiškoknjižne listine, s katerimi se lahko doseže odpravo formalno nepopolne listine. Kot pogodbeni način vzpostavitve zemljiškoknjižne listine je najprej predstavljena sklenitev posadne listine, kjer gre za izjavo, s katero se prizna izvirna pridobitev stvarne pravice. Nadalje je opisana vzpostavitev zemljiškoknjižne listine s pomočjo sklenitve listine o uskladitvi zemljiškoknjižnega stanja z dejanskim, s katero se nadomešča izgubljeno oziroma uničeno listino o pravnoposlovni pridobitvi stvarne pravice. Sledi opredelitev sodnih načinov vzpostavitve zemljiškoknjižne listine, in sicer najprej vzpostavitev na podlagi pravnomočne ugotovitvene sodbe, s katero se ugotovi obstoj, spremembo oziroma prenehanje pravice, katere vknjižba se predlaga, ter nato vzpostavitev na temelju pravnomočne sodbe na izstavitev za vpis primerne listine ali priznanja podpisa na zemljiškoknjižnem dovolilu. V primeru, da na noben od navedenih načinov ni mogoča vzpostavitev zemljiškoknjižne listne, Zakon o zemljiški knjigi predpisuje poseben zemljiškoknjižni postopek za vzpostavitev zemljiškoknjižne listine, katerega postopek je prav tako podrobneje opredeljen v diplomskem delu. Opisani teoretični del diplomskega se prepleta z opisi primerov iz aktualne sodne prakse, in sicer od leta 2013 naprej, ki na podlagi dejanskih stanj navezujejo na posamezne načine vzpostavitve zemljiškoknjižne listine.

The thesis presents the regulation of different alternative methods of restoring a land document which covers a comprehensive theoretical overview with the emphasis on review and analysis of the current Slovenian case-law. The introduction of the thesis identifies the land registry law, extensively explains the basic land registry principles, and furthermore, explains the entry in the land registry as an important institution for the formation of rights »in rem« on real estates in the land registry law. Following the introduction, the thesis describes the documents which can be considered as a legal basis for the entry in the land registry and must comply with strict legal requirements. Registration of the right in the land registry without a valid document is impossible. Therefore, a proper document must be established for the acquisition of the rights “in rem” in order to achieve the objective, which is to establish a legal basis for the transfer of rights “in rem” and for the entry in the land registry.
The central part of the thesis presents different methods of restoring a land document, through which the abolition of invalid documents can be achieved. As a contractual method of restoring a land document the conclusion of a document which contains the declaration recognising the original acquisition of rights “in rem” is presented firstly. Furthermore, it describes the restoration of a land document through the conclusion of the document on the harmonization of land registry sheet to the actual one, which replaces a lost or destroyed document on the acquisition of the rights “in rem”. Afterwards the thesis specifies legal methods of restoring a land document, commencing with the restoration of land document on the basis of final declaratory judgement, declaring the existence, modification or termination of rights whose registration is proposed, following by the restoration of land document on the basis of final judgement, issuing of a document necessary for the registration of right in the land registry or recognising the signature on the permission to entry in the land registry. In the event that none of the above described methods of restoring a land document can be taken into consideration, the Land Registry Act stipulates a special land registry procedure for restoring a land document, which is specified in detail in the thesis. In the final part the thesis describes practical examples from the current case-law which defines different methods of restoring a land documents based on the actual situation in relation to the different methods of restoring a land document. |
