Abstract

Zemljiška knjiga je javna evidenca, v katero se vpisujejo podatki o pravicah na nepremičninah in pravnih dejstvih v zvezi z nepremičninami. Njena glavna funkcija je publiciteta podatkov, za katere zakon določa, da se objavijo v zemljiški knjigi. Zakon o zemljiški knjigi določa, da se ob pravicah v zemljiško knjigo vpisujejo tudi nekatera pravna dejstva, ki so pomembna za pravni promet, in sicer z zaznambo. Eno od pravnih dejstev, ki se zaznamujejo v zemljiški knjigi, je potek spora o knjižni pravici. Zaznamba spora je namenjena publiciteti stvarnopravnih sporov in pride v poštev le kadar gre za spor o izvirno pridobljeni stvarni pravici ali prenehanju pravice ter v postopku določitve nujne poti. S tem se varujejo že pridobljene oziroma ukinjene stvarne pravice, kadar zemljiškoknjižno stanje ne ustreza dejanskemu. V primeru obligacijskopravnih sporov v zvezi s pravicami na nepremičninah pa daje enakovredno varstvo predznamba pravice v zemljiški knjigi. Pomen zaznambe spora je v varstvu vrstnega reda za vknjižbo pravice, o kateri poteka spor, kar je pomembno zaradi učinkov načela zaupanja v zemljiško knjigo. Varstvu vrstnega reda vpisov so namenjene tudi zaznamba izrednega pravnega sredstva, zaznamba izbrisne tožbe in zaznambe tožb v posebnih zemljiškoknjižnih postopkih. Zaznamba spora je v hrvaškem pravnem redu urejena podobno kot v slovenskem. In sicer ima enake pravne učinke in varuje vrstni red za vpis pravice v zemljiško knjigo. Vendar hrvaško pravo omogoča vpis zaznambe spora tako v primeru stvarnopravnih sporov kot tudi v primeru obligacijskopravnih sporov v zvezi z nepremičninami.

Secondary title: Publication of property law disputes in the land register with overview of the current case law
Secondary abstract: The land register is a public record for data regarding real estate rights and legal facts concerning real estate. Its main purpose is the publication of information that need to be published according to the law. The Land Register Act defines that in addition to rights some legal facts important for legal transactions are also entered with annotation. One of the legal facts annotated in land register is the process of dispute regarding land registry right. The annotation of dispute is intended for the publication of property law disputes and is applicable to disputes regarding the original acquisition of right in rem or termination of that right and in procedures of determining the way of necessity. Consequently, already acquired or terminated rights in rem are protected even when the status in the land register does not correspond to the actual state. In the case of obligation law disputes relating to real estate rights, a preliminary note provides equivalent protection. The importance of the annotation of dispute lies in the protection of the consecutive order for registration of the contested right, which is important due to the effects of the principle of trust in the land register. Annotation of extraordinary legal remedy, annotation of cancellation action, and annotation of lawsuits in special land registry procedures are also entered into the land register for consecutive order protection. The annotation of dispute in the Croatian legal system is regulated similarly as in the Slovenian. It has the same legal effects and protects the consecutive order for registration in the land register. However, the Croatian legal system allows annotation of dispute entries in the case of property law disputes as well as in the case of obligation law disputes related to real estate.
