Abstract
Računalništvo v oblaku je oblika storitev, ki omogoča širok obseg uporabe, tudi obdelovanje osebnih podatkov. Pri obdelovanju osebnih podatkov je v Evropski uniji potrebno spoštovati temeljna načela Direktive 95/46/ES, ki je osrednji pravni akt za varstvo osebnih podatkov v Evropski uniji. Njen temeljni cilj je varovanje pravic in svoboščin fizičnih oseb in njihove zasebnosti.
Tveganja, ki jih uporaba storitev računalništva v oblaku predstavljajo, so tesneje povezana s tremi področji, ki so: pogodbeno obdelovanje osebnih podatkov, zavarovanje osebnih podatkov in iznos podatkov v tretje države. Vsi subjekti, ki so vključeni v ta področja, morajo zagotoviti varstvo osebnih podatkov in spoštovanje temeljne pravice posameznika, na katerega se podatki nanašajo, to je pravice do zasebnosti. To zagotavljajo s pomočjo organizacijskih in tehničnih ukrepov, s spoštovanjem medsebojnih pravic in obveznosti, in z ukrepi za zavarovanje podatkov.
Evropska unija stremi k temu, da bi bila zagotovljena enotna raven varstva osebnih podatkov v vseh državah članicah. Z zakonodajnim okvirom, s spoštovanjem temeljnih načel, s številnimi smernicami, z odločitvami Sodišča Evropske unije in s standardi, želi povečati zaupanje v varnost storitev računalništva v oblaku za obdelovanje osebnih podatkov. Pomanjkanje zaupanja s strani upravljalcev, obdelovalcev in nadzornih organov, je temeljna ovira za njihovo uporabo.

Cloud computing is a form of services, that allows wide area of use, including processing of personal data. By processing personal data in the European Union, it is necessary to respect the fundamental principles enshrined in Directive 95/46/EC, which is the main instrument for the protection of personal data in the European Union. Its primary objective is to protect the rights and freedoms of individuals and their privacy.
The risks related to the use of cloud computing services are most closely associated with three areas: i.e. contract processing of personal data, protection of personal data and transfers of data to third countries. All parties involved in these areas must guarantee protection of personal data and respect of individual fundamental rights, on which they are related to, that is the right for privacy. They ensure that with organisational and technical measures, by respecting their mutual rights and obligations and with measures for data protecting.
The European Union strives for a uniform level of protection of personal data in all Member States. With legislative framework, by respecting fundamental principles, with a number of directives, with Court of Justice of the European Union decisions and standards, it stems to increase confidence in the security of these services. Lack of confidence from data controllers, data procesors and protection authorities, is a fundamental obstacle for their use. |
