Abstract
Javna naročila so javni izdatki s katerimi država zadovoljuje javne potrebe. V splošnem, predstavljajo javna naročila blago, storitve in gradnje. V Republiki Sloveniji se nameni za njih skoraj polovico državnega proračuna in je zato pomembno za kaj se ta sredstva porabijo in na kakšen način. Recesija preteklih let je države članice EU še dodatno spodbudila k racionalni porabi javnih sredstev. Eden izmed načinov racionalizacije javne porabe je centralizacija javnega naročanja. Centralizacija javnega naročanja pomeni, da se ustanovi oz. določi osrednji nabavni organ, ki na podlagi ugotovljenih potreb javnih naročnikov izvede postopke javnega naročanja. Na ta način se zmanjša število istovrstnih postopkov javnega naročanja, stroški postopkov, izboljša se organizacija delovnih procesov; najbolj pomemben učinek je zagotovo ta, da se zaradi združevanja naročil, ki pomeni povečano povpraševanje, doseže boljša pozicija pri pogajanjih s ponudniki, kar vpliva na ceno predmeta javnega naročila.
Centralizacijo javnega naročanja predvideva tudi Direktiva 2014/24/EU. Republika Slovenija jo je kot članica EU morala implementirati v svoj pravni red do 1. aprila 2016. To je storila s sprejetjem Zakona o javnem naročanju (ZJN-3).

THE CENTRALISATION OF PUBLIC PROCUREMENT IN REPUBLIC OF SLOVENIA |

Public procurements are public expenditure through which the government meets public needs. In general they refer to contracts for the delivery of goods, performance of goods and/or rendering of services. In Slovenia almost half of the national budget is devoted to this purpose therefore it is vital how and to what purpose these assets are spent. The recession of the past few years has stimulated all EU Member States to additionally rationalize the use of public finances. One way of rationalizing public expenditure is by centralization of public procurements which generally means the establishment of the general purchasing body which follows the procedure of public procurement based on the pre-established needs of public contracting authority. As a result, the number of similar procedures and their costs can drop and the organization of working processes improve, but most importantly, group procurements which equal increased demand achieve a better negotiating stand with tenderers and thus affect the price of public procurement matter.
Centralization of public procurements is also provided by Directive 2014/24/EU. Republic of Slovenia, as a Member State, had to implement it within its national legal system by 1 April 2016 by passing the Public Procurement Act (ZJN-3). With its adoption Public Procurement Law (ZJN-2-UPB5), Uradni list RS, No. 12/13 and No. 19/14 and Act Regulating Public Procurement in the Water, Energy, Transport and Postal Services Sectors (ZJNVETPS), which had dealt with centralization of public procurement and joint public procurement of the Government of the Republic of Slovenia, were revoked. |
