Abstract

Diplomsko delo obravnava obliko sodnega postopka imenovanega upravni spor v okviru prava Združenega kraljestva. V izhodišču je za lažje razumevanje predstavljen zgodovinski razvoju upravnega spora. V nadaljevanju diplomsko delo predstavlja pojem upravnega spora kot postopek, v katerem je omogočeno posamezniku, da izpodbija odločitev, ukrep ali molk javnega organa ali kateregakoli drugega subjekta, ki izvaja naloge javne narave. Nadalje so obravnavani pravni temelji upravnega spora: nezakonitost, iracionalnost, postopkovna nepravilnost in proporcionalnost. Diplomsko delo zatem obravnavana stranke v postopku upravnega spora, katero sodišče je pristojno odločati v upravnem sporu in roke, v katerih je potrebno vložiti upravni spor. V nadaljevanju je predstavljen dvostopenjski postopek upravnega spora ter vmesna in končna pravna sredstva uporabljena v postopku upravnega spora.

Secondary abstract: This thesis focuses on a special judicial proceeding, called judicial (administrative) review in United Kingdom law. Initially, historical development of judicial review is outlined for better and further understanding. Thesis continues with the term of judicial review, in which a person or an organization is allowed to challenge a decision made by a public body or any other body, when exercising public law functions. Illegality, irrationality, procedural impropriety and proportionality are grounds for judicial review and are discussed below. Thesis continues with clients, courts, time-limits of the procedure and a presentation of the two-stage process. Finally, the interim and final remedies are presented.
