Abstract

Diplomska naloga obravnava problematiko uveljavljanja sodnega varstva v primerih kršitev osebnostnih pravic z objavami na svetovnem spletu, predvsem kadar kršitelji želijo ostati anonimni. Informacijska revolucija, ki smo ji priča danes, je poleg tega, da je omogočila več sto milijonom ljudi, da zlahka in ob znatno nižjih stroških izmenjujejo mnenja, stvaritve, dokumente, prinesla s seboj tudi veliko nerešenih pravnih vprašanj, s katerimi se države različno spopadajo. Ugotovitve kažejo, da nas v prihodnosti čaka tehtanje med pravico do svobode izražanja in varstvom osebnostnih pravic, ki se preganjajo na zasebno tožbo, in o tem, ali je varovana pravica prizadeta v meri, ki opravičuje razkritje identitete domnevnega kršitelja. Posledično problem ureditve kazenskopravnega varstva osebnostnih pravic pripelje tudi do problema uveljavitve civilnopravnega varstva, kar pomeni, da oškodovanci na koncu ostanejo brez ustavno zagotovljenega sodnega varstva. Vprašanja možnosti sodnega pregona tistih, ki storijo kazniva dejanja zoper čast in dobro ime preko spletnih objav, so razmeroma nova, zato ni presenetljivo, da se pri urejanju teh vprašanj v zakonodaji še lovimo in iščemo ravnotežje med različnimi ustavnimi in človekovimi pravicami. V zadnjem poglavju diplomske naloge pa se dotaknem tudi vprašanja penalne odškodnine, in sicer se zavzemam za to, da je ograja meji svobode izražanja daleč, ko pa se postavi, naj bo dovolj visoka.

Secondary abstract: This thesis is about problems arising with enforcing judicial protection in cases of violation of personal rights concerning posts on the internet, especially in cases where the offender wants to stay anonymous. The revolution of information technology as we are witnessing it today has not only enabled hundreds of millions people to, easily and with low costs, share opinions, creations and documents, but it also brought a great number of legal questions which different countries have their own way to deal with. Findings show that in the future there will be a lot of weighing between justice and freedom of speech and protection of personal rights, which are prosecuted in direct action and if this protected right is affected in such extent, that it justifies the disclosure of the offender’s identity. Consequently the problem of regulating criminal law protection of personal rights brings us also to a problem of implementation of civil law protection which means that injured party is left without the by constitution ensured judicial protection. Questions about persecution of those who commit criminal offense against honor and reputation over the online posts are a novelty, so it is not surprising that in dealing with these questions we are still searching for a balance between different constitutional and human rights. Last part of the thesis I talk about the question of penal damages and I stand for that boundary of freedom of speech is still far away, but when it is set it must be set high enough.
