Abstract

V Sloveniji pravih raziskav o tem, koliko zdravniških napak se zgodi letno, še niso izvedli, toda če prenesemo podatke, ki so jih zbrali v primerljivo razviti državi, naj bi zaradi zdravniških napak vsako leto umrlo okrog tisoč ljudi. Vendar to je le statistika, v ozadju statistike pa so zgodbe ljudi, žrtev teh napak. Z gotovostjo lahko rečemo, da je delo zdravnika eden izmed najzahtevnejših poklicev. Gre za zelo natančno, odgovorno in stresno delo. Rezultat zdravljenja ni odvisen samo od skrbnega ravnanja zdravnikov. Vsako telo se drugače odziva na zdravljenje. Tudi v primeru pravilno izvedenega zdravljenja lahko pride do poslabšanja zdravja. Če do zapleta pride med zdravljenjem, kljub temu da je potekalo strokovno neoporečno in z največjo mero skrbnosti, ne moremo govoriti o napaki, ampak o nesreči ali komplikaciji. Gre za naključno in ne preprečljivo dejstvo. Kadar se zdravje poslabša zaradi zdravljenja, ki odstopa od profesionalnih standardov strokovnega ukrepanja, skrbnosti in pazljivosti, pa govorimo o zdravniški napaki. Možne so tudi zdravniške napake, ki povzročijo smrt zarodka. Gre za delikatne primere, pri katerih pride do trka zdravstvenih, etičnih, pravnih, znanstvenih in drugih stališč. Vprašamo se, ali je odškodnina zadostna kazen za smrt nerojenega otroka. Slovenska zakonodaja se zavzema za stališče, da je zarodek le del materinega telesa in ne samostojna pravna entiteta in v opisanih primerih zdravnik torej ne odgovarja za kaznivo dejanje nenaklepnega uboja nerojenega otroka.

Secondary abstract: Slovenian researchers have not yet discovered how many medical errors actually take place in Slovenia, but if we transfer the data that was gathered in a comparably developed country it shows that each year dies around thousands of people due to medical errors. But this is just a statistics. Behind the scenes there are actual people that experienced those errors. With certainty we can claim that a work of a doctor is in fact one of the most challenging professions. It is a very precise, responsible and stressful job. The results of treatments do not depend only on an attentive doctor. Each body responds to a certain treatment differently than the other. Even in a case of a perfectly executed treatment the medical condition can worsen. If an incident occurs during treatment, although it was carried out professionally correctly and with utmost care, we cannot talk about mistakes but about complications. This is a random but an unpreventable fact. When health deteriorates due to the treatment, which deviates from the professional standards of professional action, diligence and vigilance, we are talking about the error. Some medical errors results in deaths of unborn children. These are delicate cases in which medical, ethical, legal and scientific views clash. The question is whether compensation suffices in the case of death of an unborn child. Slovenian and French legal systems stand for position that an embryo is only a part of the mother's body and is not a separate legal entity and in the case described, the doctor is therefore not liable for the offense of manslaughter of the unborn child.
